  • BW Legal and the misterious CCJ. HELP!

    Firstly can I say hello to the forum as I am new and in need of help.

    I have been informed by BW Legal I have a county court judgement against me and owe a certain amount of money. The problem is I have never been informed about any judgement etc against me. I have been online for a week trying to find the judgement. Nothing on any of my credit files, nothing what so ever on trustonline... My question is if a judgement isn't showing any where does it exist or is BW legal trying to pull a fast one. Please help I can't find any answers anywhere.

    You need to write to BW and ask them supply any information they have relating to the CCJ as you were previously unaware of it.

    Do have any idea what the debt was for?

      It is not " unknown" for some DCA's / Debt Purchasers to allege that a judgment has been made, if it's not on trust on line and does not show on credit reference file is it certainly more than a little suspicious.

      Dear BW Legal.

      I refer to a letter dated ............ in which BW Legal alleges it has obtained a County Court Judgement against me.

      I have meticulously check my credit files and public records and can find no trace of any such judgement.

      BW Legal will either confirm in full detail the existence of any alleged judgement I require the following information by return of post.

      1. A copy of the N1 claim form, complete with the Claimants name and address, and the full particulars of the claim.
      2. The date of any hearing regarding this and the court at which it was heard.
      4. The Address to which it is alleged the was sent.

      Keep it short and concise.

      Use signed for post and check delivery.

        Hello to the forum,

        I have wrote on here before but no one returned an answer so I thought I would try again as things have turned and I need help ASAP.

        Quick background. I had a car with black horse and fell into financial trouble so the car was repossessed, sold for a fraction of the cost e.t.c. I was informed this was the end of things. The repossession happened in 2012. Since then I have had a bonfire full of letters from Lowell and bw legal which were ignored as they couldn't produce the documents I asked for.

        Over the last few months however I have received letters from bw legal with some high demands. I wasn't worried at first until they threw into the mix that I had a ccj judgement against me. Intrigued as I havn't been summoned to court or anything I told them this wasn't true but they were still adamant that it was. I checked every credit file I knew and nothing, I paid for the trust website and still no judgement, nothing. I emailed them back stating this wasn't the case. The letter reply they sent was still saying I did, and that they were applying for an attachment of earning order? I said ok if that's the route you want to go but I will not be acknowledging the debt until proof can be obtained. In the past week they have sent me a letter titled Notice of Enforcement Action. It has all the usual name, creditor, balance due etc. The line that is puzzling me is: You have failed to pay the amount outstanding under the county court judgement. Your judgement arrears are detailed below. Judgement arrears £0.00
        We have now issued enforcement proceedings in the form of an application for an attachment of earnings in Rotherham county court. You will hear from them soon.

        Well I am baffled as its like im on a roller coaster do I don't I, is there isn't there?

        I received a further letter saying they were going to clarify and prove the ccj but all they sent is a balance sheet from black horse.

        I need help as I have never been to court in regards to this

        is there a ccj ( nothing is showing on trust ),

        What does judgement arrears £0.00 mean?

        Are they pulling the worst tactics known to a dca?

        What should I do?

        Please someone help I am in need of it big time.

          Hi, I'm sorry no one replied to your previous post.

          Did Lowell mention a date of the Judgment? Maybe give Rotherham court (or possibly northampton business centre) a call and ask them about it. Have they given you a claim reference number ?

          I'm not suprised you are puzzled with nothing showing on trust online or your credit file.

          You will need to apply to set aside the judgment to put the warrant on hold (if they have one).

          We might be able to get a better idea of what's going on if you can photo/scan the letters you have had.
