    The defence is absolutely fine, it has everything in your need for a simple, no evidence supplied defence.

    I've added on para 9 just to make it absolutely clear you deny any liability as the claim stands.

    You're submitting it via MCOL aren't you? should automatically add the statement of truth in there so no need to write it as well.

    This will be sent by the court to the claimant and they will respond to the court if they wish to continue, then you will be allocated to your local court ( you'll get a questionnaire asking which court you want) and then the court will hopefully issue directions to the claimant to provide evidence.

    1. The Claimants claim is for a debt is alleged to be owed to O2 on A/C No. xxxxxxxxx.
    2. The Defendant does not recognise the debt from the details given and is unable to ascertain whether there is any amount owing to the original creditor.
    3. Despite requests for information from the Defendant (made under CPR 31.14), the Claimant has not provided any further details as to how the sums claimed have accrued or copies of any agreement/contract between O2 and the Defendant.
    4. No date of inception of the account has been given.
    5. No default notice has been received by the Defendant.
    6. The claimant states that the account was assigned from O2 to Lowell Portfolio I on 30/11/2010. The Defendant has not received any notification of this assignment.
    7. Under Civil Procedure Rule 16.5 (4) Where the claim includes a money claim, a defendant shall be taken to require that any allegation relating to the amount of money claimed be proved unless he expressly admits the allegation. Therefore It is expected that the Claimant be required to prove the allegation that the money is owed as claimed.
    8. Should the Claimants adequately evidence the debt the Defendant reserves the right to amend his defence.
    9. It is denied the Claimant is entitled to the relief as claimed or at all.

        Hi all,
        I just had 2 replies off BC, the first is a standard reply and a second which came 3 days after and is dated 5 days before first letter.
        Does the second letter mean they have all the proof they need against my son and should we contact them to try and mediate?
        How long do we have to respond?
        Please help I'm getting stressed now lol.

          All these letters show is Carter couldn't organise a P up in a Brewery. Carter I think uses a cheap bulk postage system which leads to a
          very fragmented and unreliable service.
          The 3rd letter in your attachments appears to be an undated afterthought .


          It appears to me that mediation is still available and a Tomlin (Consent) order could be sought if mediation results in an acceptable payment plan being agreed by both parties, the advantage of this is no CCJ is made, and as long as the agreement is maintained no further " debt collection activity" will take place, if the debtor fails to maintain the agreed payments the creditor can seek summary judgement.

                CCA Request to Lowell done??
                If so when? Lowell has 12 + 2 working days to comply if the agreement has not been produced
                the debt is unenforceable until it is produced.

                Has you defence gone in and been acknowledged?

                  Yes CAA done, and defence.
                  "Your defence was received on 11/03/2015 at 08:00:52",
                  And then they sent the 2 letters I posted above, post #18.
                  Is the second letter a reply to CAA?
                  Would it be best to try and settle or carry on defending?
                  I'm really lost here, that second letter looks like they have all the information they need to go ahead and prosecute.

                      Have you not had anything back from the court since submitting your defence ? That's usually a couple of weeks, and the claimants have 28 days to respond to it. There's still no copy of the agreement from O2 is there ? or statement of account or any of the things you requested?

                      If you want to negotiate and take up their offer of a tomlin order with a monthly installment to save you defending further then you'd need to get in touch with them, personally I would wait until you hear back from the court as to whether they are continuing first..... usually you'd receive the N180 / Small Claims questionnaire at that point - and you can tick to mediate through the court at that point.


                      edit: just checked back and your defence was entered over a month ago - maybe give the court a buzz and see if the claimants have responded at all (ask them the current status of the claim)....

                          It would be a good idea to check directly with the court on the status of the claim. Carter cannot be trusted to act properly or reasonably imo.

                            I received the Form N180 this week and have filled it in and about to return it.
                            One quick question, do I have to send a copy to BC? Is this a requirement?

                                Hello. Don't panic! Bryan Carter Solicitors are renowned for using bullying tactics in chasing 'debts' that aren't real. I've just defeated them in claim they brought against me from a non-existent debt I was supposed to owe O2. Even before we went into court they asked if we could call it off - I had counterclaimed - and both agree to walk away. I refused so we went into court. As soon as we sat down the judge told the legal agent BCS had sent along - they didn't have the balls to turn up themselves - that he effectively had no case because not one original document in support of their claim that I owed O2 around 400 was supplied to the court. She eventually threw out their case. I would suggest that anyone in similar circumstances who has BCS chasing them for money fight it and ask them to prove their claim with original documents. In most cases I've heard about - and including my own - they have nothing to back their bullying other than a knowledge of how to manipulate the law to scare people. I am deliberating as to whether to take out a private case against them because they supplied a doctored exhibit to their witness statement i.e. they lied to the court about the veracity of a document with the intention and objective of getting money from me. Fight them and don't be scared!
