    please help, need advise about what to do,been looking at difference cases on here ,I need to fill in an n244 form as I never received an claim form n1

      I received a Judgment for Claimant from St-Katherine House Northampton from Mortimer clarke Solicitors acting on behalf of Cabot ,that I must pay the claimant £2,923.31 for debt and £207.00 for court costs.You must pay the claimant a total of 3,130.21 forthwith.This for a credit card I had with Sainsbury.As far as I was aware I payed this off with an DCA called IQOR.Never heard anythink else till now panicking now on what to do,never got a claim form.I rang the court on Friday and he sent me a N244 ‘Application Notice’,just need to know what I need to do

          Thanks amethyst,but not sure what I do,DO I ring cabot and ask them to set aside of the judgment,if they say no what then.Do I ring the court and fill the form in and pay for it on the phone, not really good at filling out form,what do I put in my form for support to my claim,thanks

            Yes you can ring Cabot (or write to them) and ask them to consent to set aside the judgment because you didn't receive the papers and don't know what the debt is - ask them to send you copies of the court papers and any other info on the debt so you can consider your position - if they refuse then you'd complete the N244 as per the link - if they agree you'd also complete the N244 but it would only cost you £50 rather than £155 if they don't.... so it is worth asking.

              Thank for that information,not to sure what you mean about the cost eg, £50 or £155.What im worried about now is the judgment for claimant took place on the 19-jan-2015, so have I still got time to sort it out.

                £50. court fee if Cabot consent to set aside £155.00 if they don't and a hearing is needed.

                  Thanks for that nem.So I will ring them in the morning and see what happening.There another problem with ,what I don't understand is I got a letter from cabot back in oct 2014 saying that we have referring your account to Marlin financial services to recover your account.So as far as I was aware I'm with marlin,but on my solictors and judgment for claimant it say Cabot.But I do know that cabot, marlin and Mortimer clarke Solicitors are the same company.When I sent my n244 form do I do it on line and pay at the same time or do I ring them and sent the form .I'm glad I found this site ,its very interesting to see how people help each other,thanks

                    Cabot swallowed up Marlin so no all the same group. Cabot buying debt, and using Marlin/Reston to manage and collect.
                    Ring Cabot first the complete and I would Post the N244 with the appropriate fee afterwards.

                    This is an excellent site the wealth of knowledge and experience is second to none, non judgemental whatever the problem!!

                          Just rang caot financal ltd to ask them if that would consent to set aside the judgment because i didn't receive the papers and don't know what the debt is ,they transfer me Marlin financial services and said you need to ring Mortimer clarke Solicitors ,is this right please help
