    So reversed on those ground etc under BOBS/FCA rules etc, as otherwise you would have been unable to meet essential commitments such as the mortgage.

        I have now received my bank statement for this transaction. The credit company took £1500 pounds from my current account and credited my card with said amount. I recall phoning the bank and stating that I had not authorised this payment. Even though they are part of the same group the money was returned to my current account the following day. The bank statement refers to the transaction as " correction". The claimant is unaware of this and has described the payment as a bounced payment.

        They have applied to have the stay lifted. So they took the money and returned it. I cant see how this can be classed as an action by myself. I believe this means my case is still statute barred.

        Do you agree ?

        When do I produce this evidence

          Your stance remains the same you did not authorise the payment and clearly it was acknowledged as an " error" in my opinion Statute Barred stands.

            Do i have to submit another defence. I presume I will receive some notification of the stay being lifted. Or can I ambush them with this in court.

            I spent hours in the law library and can found nothing on a case like this!

              Keep in contact with the court then you can't be caught out.
              I haven't had time to read back on the thread Labby is the defence sent filed on the basis of statute barred?
