    Hello all

    I hope you would be willing to help me, today I received a court claim form from MKDP LPP regarding a lloyds TSB Credit Card debt of £16,041.80. I have been reading some threads regarding issues will MKDP and court claims and the advice given looks good.

    I have had dealing with Capquest back june 2013 and sent them a CCA request, then did not supply the CCA and told me the matter had been closed. I have heard nothing since, until today


    Particulairs of Claim


    The claiment claims the sum of £16041.80 being monies due from the Defendant to the claiment under a regulated agreement originally between the defendant and Lloyds bank PLC.
    The Defendant account number xxxxxxxxxxxxxx and was assigned to the claiment on the 20-06-14, notice of this has been provided to the defendant and no monies have been paid. The defendant has failed to make payments as per the agreement and a default notice has been served pursuant to the consumer credit act 1974.
    The claiment claims the sum of £16041.80 plus costs. The complainent as far as necessary, with the pre-action conduct practice direction.

    Date of issue is the 19-01-15

    No I admit my job means i move round alot but I do not recall any letter sent from MKDP and I certainly do not have an agreement with them. So how could i have missed payments have once requested a CCA from capquest which they could not supply.

    I have read a few threads on here as i mentioned so was going to go down the CCA, CPR 31.14 route is this correct?

    Also if it does go the court could i get heard in a local court northampton is a far way from me.

    Defence Date is February 21, 2015 - Lloyds Credit Card - Do you know when you took out the card ?

    What's your situation (ie would getting a CCJ devastate your life ? and could you afford reasonable installment payments ?)

    That sounds hopeful Do you know when you last acknowledged/paid anything on this account ?

    Okay so yes you need to acknowledge the claim and send a CPR and a CCA request - as you are going to be in fast track you could also send a Part 18 request for other information you need, ie. how the sum claimed has been calculated, the date of the last payment etc.

    If it gets to court then yes, it will be transferred to a court near you, after you have defended the case you will receive a form which asks you which court you'd prefer.

    CPR request can ask for the Agreement, Notice of Assignment and Default Notice

    Sorry for the cut and paste but simplest way to give you the info

    1: ACKNOWLEDGE THE CLAIM - you can do this online usually at www.moneyclaim.gov.uk
    You'll need your claim reference and password from the front of the claim form - this will extend the time you have to respond to the claim to 28 days from when you received it

    2: Send A CCA REQUEST to the CLAIMANT ( see here )
    This applies to all credit cards / loans / hire purchase / store cards type debt. It doesn't apply to Mobile Phones / Utilities or Overdrafts.


    3: Send a CPR request to the CLAIMANT'S SOLICITORS ( see here )

    This applies to everything unless they happen to have supplied you with a bunch of paperwork to back up their claim (v. unlikely)

      Hi and thanks Sharon

      The card would have been taken out late 90's early 2000

      A Ccj would be far from ideal and any payment I could make would only be small.

      The last payment taken from my account was nov 2010, and it was taken from my account as soon as my wages went in leaving me with nothing for the rest of the month. Lloyds started taking any credit balance from my account to pay the charges and the debt never reduced.

      I will send the Cca and CPR request off this week,

      would you you be able to clarify the section 18?

          I have read through the link, am I correct to assume that a part 18 is a more formal way of requesting the CCA and CPR?

          If so should I send them all off together?

            Hi all,

            Just a quick update claim acknowledged and CPR and CCA request sent off so I guess just wait and see what comes back and file my defence before the 21-02-15.

            Thanks for all your help upto to now. Should I want and see what comes back before filing my defence?
