Re: BLUE FORM RECEIVED FROM nORTHAMPON

I have started to do letters for cca and cpr , on the cpr letter what date should I put on the part where I am asking to inspect documents ahead of filing my defence ( 2nd paragraph ) do I put tomorrows date as that's when I am going to acknowledge the claim and tell the court I intend to defend .
So very sorry for asking so many questions but I really am a complete novice here.

Re: BLUE FORM RECEIVED FROM nORTHAMPON

The claimant claims the sum of £2813.62 being monies due from the Defendant to the claimant under a regulated agreement between the defendant and Lloyds bank PLC .
tHE DEFENDANTS ACCOUNT NO WAS ---------------- AND WAS ASSIGNED TO THE CLAIMANT ON 20/06/2014 ,NOTICE OF THIS HAS BEEN PROVIDED TO THE DEFENDANT .ETC

So in the CPR Letter you should ask for

        Regulated Agreement
        Notice of Assignment

Don't I have to ask for default notice , it does say under particulars that The defendant has failed to make payments in accordance with the terms of the agreement and a default notice has been served pursuant to the consumer credit act 1974 ?

I have sent appropriate letters by recorded /signed for post , was just wondering what can I expect to happen next ? will the court contact me ? I acknowledged on line and stated I was defending the claim , didn't quite grasp the online form , did say I was defending and was awaiting appropriate documents from the claimant to see if their claim was justified , am worried now in case Ive done it wrong

Re: BLUE FORM RECEIVED FROM nORTHAMPON

It's just a waiting game for now ... you've acknowledged the claim, sent off the CCA and CPR letters. Your defence isn't due until the 15th February, so you should get a response from both before then. Any letters you get, you can post up on here (redacted) for advice etc... and closer to your defence date, you'll get lots of help with that too :tinysmile_grin_t:

Try not to worry :tinysmile_twink_t2: Have a look around some of the other threads on here (if you want) to get an idea of the whole process.

Re: BLUE FORM RECEIVED FROM nORTHAMPON

Hi, when its said that my defence date is 15th Feb , what does that mean exactly ? Is that when I have to provide the court with a defence statement or the evidence that the claimant has sent me ?
And approx. how long after that would I have to go to court ?
If The claimant doesn't provide anything what happens then ?
So sorry but its a first time for me , all these questions running through my head and every day wake up feeling sick about the whole thing xx

Re: BLUE FORM RECEIVED FROM nORTHAMPON

Update , just got home from work to find a letter from Northampton .it reads as follows
I acknowledge receipt of your defence. A copy is being served on the claimant ( or the claimants solicitor)
The claimant may contact you direct to attempt to resolve any dispute. If the dispute cannot be resolved informally , the claimant will inform the court that he wishes to proceed . The court will then inform you of what will happen.
Where he wishes to proceed , the claimant must contact the court within 28days after receiving a copy of your defence. After that period has elapsed , the claim will be stayed . The only action the claimant can then take will be to a judge for an order lifting the stay.

Is this all ok ? Is this what normally happens ? xx
