    I was self employed up till sept last year, when I had a heart attack in a customers home, so I was unable to work for a while, I was buying supplies for work from wholesaler paying on 30 day credit, anyway I missed that months payment of 600 pounds as it slipped my mind, anyway next thing I got letter from Lkny Law saying they had ccj issued and now got pay 1100pounds, just tried calling them to explain and offer to make monthly payment as not worked since sept and they said tough pay the full amount or we when send bailiff's round, so how else can I deal with this?

    Did you not receive a claim pack from the court?
    Has the law firm quoted a claim number and/or given details of the judgement?

      no claim pack, have got claim number on letter got in post today from county court money claims centre

        So you have had no notice that a claim was issued and therefore no opportunity to defend the claim?
        Document received from the court is this General form of Order or Judgement?
        What exactly does it say?

          it is ordered that you must pay the claimant 858.34 for debt and interest to date of judgement and 162.00 for costs you must pay the claimant the total of 1020.34

            OK what we need to know is did you receive a claim form from the court, and acknowledge service of the claim and intention to defend the claim?

                Okay, it doesn't sound like you have a defence to the debt (uless there is a dispute?), so to avoid this bailiff rubbish you should ask the court to vary the order to monthly affordable installments - see http://www.legalbeagles.info/forums/...judgment-order for some info.

                If you don't feel the CCJ should have been awarded then you can apply to have it set aside on the grounds you did not receive the claim pack -> http://www.legalbeagles.info/forums/...lication-notes for info on set aside

                Both apps have a cost attached, variation can be without a hearing so would be £50 - set aside would be £155 with a hearing.

                Acknowledge Claim - within 14 days from Service

                Defend Claim - within 28 days from Service (IF you acknowledged in time)

                If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
