  • Cabot financial and restons solicitors

    Hi I'm a newbie on here,came across you when looking for information after I received court papers from restons solicitors acting for Cabot on December 23 .
    I received a letter from Restons on 28 November saying they were instructed by Cabot financial to seek immediate payment for £782 .
    i sent of a cca to them on 12 December and received a letter back on 19 December saying that basically they won't cominicate unless I sign all documents and then the court action on 23 December.

    i have read the court section on here , I presume my first step is to acknowledge the claim and ask for more time,is this best done online or via mail ?

    Any advice on this would be very muched appreciated ,I'm very stressed out about this !!!!

    I have an impending Cabot court case myself - I personally think Cabot are just a bunch of bullies who try their luck! Don't let them stress you out. Someone more knowledgeable than me on the English court system will be along soon to help you on a practical level.

      Thanks for replying,I have just completed the online court acknowledgement .
      i have sent a cca to restons but not Cabot so do I send both again ?
      Would really appreciate some advice on my reply letter to Restons .

          There is no requirement to sign a CCA request.
          Cabot are obstructive!!
          Sign over a secure signature slip or a mesh of x's in a pale coloured font.

            Thanks ,can anyone give me an idea of how I respnd back to Restons,I have printed a cca to send to Cabot .I am unsure of what to do with restons ?

                Nope. they should be fine to 20th January ish - depending on the issue date of the claim (I've gone off the 23rd Dec date as receipt date plus 28 days). It's been acknowledged so all fine

                To Restons you would send a CPR 31.14 request for documents mentioned in their claim form - could you type out the particulars of claim - it may be they have only mentioned the agreement/contract.
