    Just spoken to the court. the claimants (Restons/Cabot) have failed to respond to my defence - hence the claim is stayed.

    I asked the court what happens now and they said:

    if the claimants want to reinstate the claim they would first have to convince a judge that there was a genuine reason for the delay in responding. Of course there isn't but I suspect they would bend the rules to get a judge on their side.

    I've decided not to waste £155 on getting it struck out - I don't have that kind of money to throw at robbers anyway.

    The court did say that if they did manage to get it reinstated then I would be informed at that stage. So a) no news is good news and b) they better be damned sure of themselves before they do.

    I would however like to express my thanks to all on this website - those who run it and also those who contribute. Apart from support you have also given me a valuable insight into this kind of thing and how 'respectable' professions can be less than moral.

    As a by the way - I have just taken Severn Trent Water to task and gained a £240 refund for overcharges over the past 2 years. And just by being pernickerty I have discovered that ALL utility companies bend the rules to get as much cash as they can from the consumer. Again less than moral. Still fighting EDF and British Gas.

    I doubt I'll post for a while unless there is something to contribute - so thank you once again

      Shorter hiatus than expected but today I received the attached.

      I am minded to write to ask where is the signed credit agreement and statements etc. Their letter states they are still willing to settle amicably.

      I bet.

      Of course my answer will the along the lines of 'naff off'.

          Would you credit it.

          Restons just tried to collar me on the telephone because I have not responded to their last missive. (I have had a bad fall and frankly haven't wanted to do much of anything since). I refused to answer their 'security' questions and told them they'd have to wait.

          Although as I see it I'm not obliged to respond if I don't want to... there really isn't much to say to then is there?

              I rather suspect that it was to try to get me to acknowledge the debt as their client 'would like to resolve this amicably'. No doubt they would have recorded the call too. I know how they like to trick people into admitting all sorts on the telephone.

              I wouldn't answer their security questions and told them to wait for my response by letter. That letter now states no more phone calls - all communication by letter.

              And thanks Nem - recovering slowly but Doc says it will be at least 3 weeks... The last thing I needed was harassment from Restons. Idiots.

                Verbal communication cannot affect anything about the status of the debt e.g. the limitation period.
                A short note to Reston stating that due to health problems all communication Must be in writing.

                    Well Done!!
                    Now if Crapbot or Restless phone again you can quote the Case Law in Roberts - v - BOS ( Appeal Court Ruling) on what amounts to harassment once a " creditor " has been told " in writing only".

                        Long time no post! Reston still chancing their arm TWELVE MONTHS after issuing proceedings. I think the time has come to spend £155 and get this sorted once and for all!
