        Okay good stuff, we'll need to work on your defence for the 23rd (it's due on the 24th but that's Saturday). There's an example here http://www.legalbeagles.info/forums/...t-Court-Claims - have a read through that - it should make things a bit clearer. We also have the option of requesting an extension of time of another 28 days if they still haven't come up with any docs before say the 18th Jan.

          I think I may have mucked up under pressure when the forms all arrived on Xmas Eve. I sent the letters as advised about the CCA and CPR and did the MCOL thing. I seem to remember that there was a section on the online court thing which said about defence and I think that I put that I had no recollection of the debt.

          The letter from the court that I have received this morning (dated 29.12.14) says that they acknowledge receipt of my defence and a copy is being served on the claimant (or their solicitor) and that they may contact me directly to resolve any dispute. If the dispute cannot be resolved informally the claimant will inform the court that he wishes to proceed. The court will then inform me of what will happen. Where he wishes to proceed the claimant must contact the court within 28 days after receiving a copy of my defence. After that period has elapsed the claim will be stayed. THe only action that the claimant can then take will be to apply to a judge for an order lifting the stay.

          Have I mucked up?

          Can you log in to MCOL and get a copy of your defence ( should be an option to download it as PDF etc) so we can see what you have put.

                    hmmm weird, that should already have been ticked when you went on initially. Might be an idea to give the court a call ( Northampton CCBC - County Court Money Claims Centre: 0300 123 1057, 01604 619 402 ) with your claim number and check witht hem the status of the claim, mention you thought you had only acknowledged so were suprised to get a letter about the defence and see what they say. Just to make sure. Ask if there's a way to retrieve what you put as your defence on MCOL.

                    if so that should be fine to get things kicked off. I'd expect a letter from the sols relatively soon 'reminding' you what the debt is, and I think we're best dealing with it from that point.

                        Ok - so I just spoke to someone in Northampton who tells me 'yes - I have put in a defence, no - he cant tell me what it was as he cant view it and no - I cant see it online either!!'

                            oh ffs, they are pants at Northampton.

                            Okay lets' assume you just wrote some thing like ' I have no recollection of this Debt' then.

                            It's not a full defence and you will have to amend further along the line ( but as this costs we'll hold off until we have more info back from the claimant ).

                            There's no issue and we're still waiting for the CCA from Cabot, you may have just sped things up a bit in your favour actually So soon as you hear anything from the claimant let us know - and don't panic if they threaten things like summary judgment / strike out defence etc type of stuff, it'll only be geared to worry you.

                            Would you be elgible for fee remission do you think ( EX160 )https://www.justice.gov.uk/courts/fees ?

                                I realise that I am probably stressing more than I need to! The letter I sent to Cabot was signed for on 5.1.15 - when do they need to reply to me by?

                                Defend Claim - within 28 days from Service (IF you acknowledged in time)
