  • unknown CCJ - NOW WHAT

    Hi,

I have done a credit check this morning to see if I am getting any better and I saw 3 CCJs (see below)
I wasn't aware of these, although I do believe from the amount the first 2 are college fees that I didn't pay.

my question is how I go about dealing with them now.

    thanks in advance

    Judgment date
    28/11/2013
    Amount
    £ 1,070

    Court name
    Money Claims Centre

    Judgment date 10/09/2012
    Amount
    £ 1,895

    Court name
    County Court Money Claims Centre

    Judgment date 02/03/2012
    Amount
    £ 991

    Court name
    My local court

So I have £3956 worth of CCJs, the oldest of which is 3 years.

My question is this, where should I go from here as I don't want to wat another 3-4 years for them to fall of my file. I need to improve my credit rating so should I try to start paying these back?

    Thanks in advance

Turns out I would have to pay £130 application fee due to my wage, meaning I would have to pay £390 (3 CCJs) without guarantee they would be set aside.

In which case you would need to sort out settlement so you can get a certificate of satisfaction which will look better on your credit file although won't clear them off.

Would the 6 years remain from the date they was put on my file or would it restart from the satisfied date?

It would still run from the date it was added to your file.

How come you didn't know about them ? Were they made at a previous address ?

Having them set aside ( if you managed it) would not necessarily help as if you then lost the CCJ would start from the beginning again.

Does your credit file show the claimant - if not you'll have to go to trust-online and look yourself up.

What's the 3rd one for? ( as it's unusual being at your local court rather than northampton ccbc )

The first 2 are for college fees and the 3rd is for a local solicitor.

I was basing my claim on the fact i lived in shared accomodation, never received the documents, they was not send by recorded delivery, as a result i didnt have the 28 days to pay etc

Well getting them set aside looks like a no go. So I guess I should ask if it is better to pay them off or leave them unsettled (from a credit file point of view)

You may pay them off and ask for a Certificate to show them Satisfied but in reality this does not do your Credit File much good as they still remain until the 6 years are up and they fall off. Even at the end of 6 years you still owe the monies it just doesn't show any more. To apply for Set Aside is £155 per application (rumoured to be going up to £255 in April) but if you owed the money then all that would happen is you would swap 1 CCJ for another - I doubt your defence would be strong enough.

Yes, except you run the risk of enforcement action, attachment of earnings, enforcement agents etc for the full six years (and thereafter if the creditor obtains the court's permission).

I you were successful in getting them set aside, which I doubt at this stage, and a new CCJ was obtained by the creditor, that would remain on your file for a further six years.

                      Sorry.

So what do you think guys, should I contact the courts to set up a payment plan or just leave them? I will pay as I don't deny the debts, will just be a case of me contacting the courts as I haven't heard from them
