      Hi Peter, Welcome to the forum

      These are the first steps to get you started...


      1: ACKNOWLEDGE THE CLAIM - you can do this online usually at www.moneyclaim.gov.uk
      You'll need your claim reference and password from the front of the claim form - bit of info on this http://www.legalbeagles.info/forums/...313#post499313

      2: Send A CCA REQUEST to the CLAIMANT ( see here )
      This applies to all credit cards / loans / hire purchase / store cards type debt. It doesn't apply to Mobile Phones / Utilities or Overdrafts.


      3: Send a CPR request to the CLAIMANT'S SOLICITORS ( see here )

      This applies to everything unless they happen to have supplied you with a bunch of paperwork to back up their claim (v. unlikely)

      These will make sure you have the full 28 days from receipt of the claim to sort out a defence ( or admission and offer) - and will make sure the claimants have all the documentation in order and have the right to make this claim against you.

      Can you recall any specific issues you have with this debt ?

      Have a read about other threads of claims on capital one debts to get an idea how things tend to progress, will help you feel you're not on your own too xx

        it was about 3 years ago and at the time I lost my job and I just ignored them to be honest as I explained situation and offered x amount a week at the time and they said no they wanted more so I hung up on them and just ignored

          Fairy Nuff - happens to lots of us Do you remember when about's you got the card ? Basically before or after 2007. Just after 2007 it's more likely the documents will be in order.

          Also what do you want to do ? How would having a CCJ affect you? Can you do a full and final negotiation if they come up with the documents or would you need to do instalments ?

            it would have been after 2007 I got the card
            not sure what I want to do I remember the debt but cant remember the amounts etc. it was probably close to 4 years ago
            don't think a ccj would affect me as I have no need for credit etc.
            and no I cant afford the full amount stated I only work part time

              Okay well let's get those letters sent out and see what they have Try not to worry and keep us up to date if you hear anything back. Once acknowledged your defence will be due before Saturday, January 17, 2015, so you will be fine until the new year once you've sent the letters out.

                hi advice please what do I do now I received a letter yesterday from the solicitor drydensfairfax

                we acknowledge receipt of your letter dated 21st December 2014
                as a result of this, we have contacted our client for confirmation and to seek further instructions, we will write to you further once they have responded.

                    That's quite normal Peter so nothing to worry on. You should look at making a start on your defence as you have no documents yet - there's an example to start from in the library - http://www.legalbeagles.info/forums/...t-Court-Claims - it will need to go in before the 17th Jan.

                          well today is 28 days from me submitting my defence and ive heard nothing just looked online and no activity either
                          am I right in thinking this means it will be stayed ?
                          also what exactly does stayed mean and once stayed what is likely to happen in future please

                              Hey, I'm new here but I wanted to comment on your post.
                              Give the court a ring and ask them what's happening with your case. I did this just now and my case has been stayed as Cabot hasn't contacted the court at all. It's been 33 days. The court told me they don't send out letters to tell you if it's been stayed or not as the claimant can still apply to overturn it. But definitely ring them so you know!! Good luck!
