      Thats me

      I have been involved in nearly all the leading cases which get quoted in consumer credit cases.

      Cases such as
      Arrow v Devlin,
      Cabot v Bachellier
      Phoenix v Cresswell
      Harrison v Link Financial High Court
      Kotecha v Phoenix Recoveries
      Grace v Blackhorse
      HFO v Wegmuller (and many other HFO cases)
      Santander v Mayhew

          How you getting on with the defence ? Just post up if you need a hand with any of it. You don't want to submit an 'embarrassed defence' as you know what the debt is and have some of the documents so you need to argue why the docs you have aren't compliant, ie illegible, lack of prescribed terms etc, and that you need the DN , assignment etc before they can enforce.

          NOTE: If you receive a court claim note these dates in your calendar ...
          Acknowledge Claim - within 14 days from Service

          Defend Claim - within 28 days from Service (IF you acknowledged in time)

          If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
