  • bryan carter solicitors court papers

    a freind recieved a letter from bryan carter saying taking me to court for a debt of £4000 did not respond to letter.
    next received a letter from county court saying to pay bryan carter £50 per month ,but to get in touch to deal with it
    we are not sure 1 if its genuinely from the county court,
    need help as what to do next
    no payments have been made since 2008 is it time barred ?

    Hi Welcome,

    I think we need to be clear on some things here.
    1. Your friend has received a county court claim and did not respond to it?
    2. The court has entered a " judgement in default" because your friend did not respond to the claim.?
    3. Does this document have a court seal on it?
    For the debt to be statute barred there must have been No payment or written acknowledgment of the debt in 6 clear years.

    If the debt was already statute barred when this claim was made then the judgement can be set aside
    So please more detail on the debt: Original Creditors Name. Type of Account, Date defaulted, who is Carters client?

      hi the papers have no seal on them
      its on behalf of lowell for originally monument credit card
      all it has is county court
      it does not say which county court

        Is their a claim number on the papers ? Easiest way of finding out is to give Northampton CCBC a call and ask them the status of the claim and give them the claim number. County Court Business Centre (CCBC) 0300 123 1056 / 01604 619400
