    Hi,

    Have old credit card debt with mbna taken out 1998 paid until late oct early Nov 2008 so not sure if statute barred. Ignored all letters but received a claim form northampton issued by Drydens on the 17th November sent acknowledgement back defending in full. Sent Cca request to drydens got letter back saying collection activity would be stopped and one from arrow more or less saying same until they here from original creditor. What do i do next about my defence do I ask for more time as I cannot be sure it is staute barred until I get the copy statements showing the date of last payment my defense has to be in by friday the 19th so help needed urgently.

      It sounds like you have done all the right things so far and your next step is to ask Drydens to agree to an extension of 28 days to give them more time to produce documents - there's a bit of info on this http://www.legalbeagles.info/forums/...filing-defence

      See what they say - if it's a no then you'll need to put in a defence, basically telling the court theres no CCA or documents evidencing the claim.

        Thankyou Amethyst,

        I had put in the wrong year it was 2008. I have emailed Drydens and are waiting for a reply. I found a letter from last December from Clarity for the same debt but it Was for £500.00 pounds more tham Drydens are asking for they are asking for £4999 why do you think the amount has changed and would this make a difference to anything

        Defend Claim - within 28 days from Service (IF you acknowledged in time)

        If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
