    Hi

    This the page 1 of 2 where i have signed and the page 2 of 2 where they have signed on the top and on the bottom i have signed for the Direct debit.

    Addition to this they have attached the Terms and conditions pages.

    Can you please advise on what are my options?

        If there's no major dispute on the agreement (ie that is your signature and you vaguely recall having the edge card now ) and there's no issues with the amount I think you should get in touch with arrow to negotiate settlement as that agreement appears to be enforceable, it seems to be the original, contains all the prescribed terms, is executed and I can't see issues with it - possibly an argument whether the additional terms were with the agreement when you signed it but sounds like they were as they are referred to at least twice as being on the customer copy, and I don't think that would get you through a court hearing.

          not sure where the capital one bit came from - I've removed the other comments I made earlier relating to capital one..

          Thinking on the EDGE card - do you remember taking it out for something specific - they were a kind of store card originally.

            In terms of negotiation, can you please advise how should i speak to them. I want to pay the lowest as possible.

            on the letter they confirmed:

            a. The total sum you have paid is £13.69
            b. The total sum outstanding is £584.00; and
            c. The amounts which will become payable comprise interest and costs, depending on what enforcement action is taken against you

            This account is currently being operated on our behalf by Drydensfairfax. We will deal with this document request only and all other enquries should be directed to them using the contact details provided below.

              It will be a case of either a WITHOUT PREJUDICE email, letter or telephone conversation, saying thank you for the documents, you now know what they are claiming for and explain you dind't put that EDGE card with Santander at all so had no idea why they were claiming against you, now you have the documents you'd be willing to discuss with them a settlement to save you both the time and costs of going through court. I don't know if you can do a full and final offer - if you can you might get more of a discount on the debt (taking into account their court fee and sols fee to date on the claim form) so say £300/£350 possibly. If you can't do that then an installment offer to keep a CCJ off your file, would probably have to be for the full amount paid over 12 month ( so something like £45 a month IF THAT IS AFFORDABLE), and both settlements if acceptable should be written into a consent/tomlin order (http://www.legalbeagles.info/forums/...-credit-claims) so they have back up security until it is paid. You still haven't had any notice of assignment or default notice, or a statement of account (which should have come with the CCA request response) so you could open with that, then move to the 'but in the interests of getting this sorted out, now I know what you are actually claiming for' etc.

              Just to clear up the 6 years bit - if you didn't take the card out until 8th November 2008 and you got the court claim 24th November 2008 then it won't be stat barred.

                  It will be Drydens (they'll have to go back to Arrow but Arrow asked you go through Drydens, and Drydens would have to draw up consent order anyway )

                    Hi


                    Spoke to Drydensfairfax and the they gave only 30 % off as deduction and they said if i were to pay then it needs to be one off payment and it'll reflect as partially settled on the credit file. Can you please advise if this is going to effect my credit?

                    The option is to pay the full balance in instalments which needs filling the court claim form.
