    sent N180 recorded delivery yesterday and ALL the letters I have sent re this I have sent to both BC and Lowell and all by recorded and kept copies! just covering my back! thanks amethyst. truly don't know how I could have got this far without you, nemesis and the support and help on here xxxxxxxxx

        Sorry I missed your post, we've had a couple of power cuts that have caused some problems.
        Amethyst is correct an " unrecorded" search is a "tracing" check often done when debt purchaser starts to pursue a debt.
        These searches are for your eyes only. It is not an in depth search.
        Your 2nd default from a "cosmetic" company (Avon?) it's is their practice to place a default if goods or payments are not made/returned in accordance with the Ts & Cs.

        Lowell may have acquired this debt, watch the CRA files the entry suddenly shows " settled" it indicates it has been sold on.

        As to the alleged debt itself, is the value of the goods you hold equivalent to that which you are owed?

          Confused what you mean nem. Only one default on my file- the cosmetics one. Not worried about that. I can sort that. Funny how it's only on experience and not other reports! I just wondered if lowell could see one default and assume it was them ha!

                I would wait and see if it's statute barred.

                If it's not, I would then try to negotiate with them at all costs to avoid a CCJ.

                    how long does it normally take from sending N180 to hearing anything? been over 2 weeks now. and its almost 4 weeks since I demanded proof of the alleged £1 payment BC said I made in 2009. checked yet another credit report and again nothing re this default.

                            Hi [MENTION=29921]nemesis[/MENTION] [MENTION=6]Amethyst[/MENTION]. came home earlier to big envelope from BC. Cover letter says...."Further to your defence please find attached statements for your information"....
                            I've not had chance to ring court yet re nem saying could be stayed so I am so confused!!!!
                            As letter says further to your defence ... has this something to do with court proceedings? (I am worried as heard nothing since N180) or is it in response to me demanding proof of alleged £1 payment?
                            With regard to the alleged £1... the statement shows all transactions and, between 22/09/06 to 22/06/13 the balance remains the same (no £1 payment in Dec 2009 ). what do I do now???

                              Hello Debs,

                              If there is no mention of the £ 1 alleged payment, this I think could indicate that
                              the payment if made was for a CCA request which would not be credited to the
                              account.

                              I take there has been no further mention/denial of the SB status of the debt?

                                They claimed last year it wasn't SB due to alleged £1. I can't remember if I sent a cca request in 2009. I certainly received no cca- that I would remember. Should I write again?
