Thank you for that. Have you managed to have a quick read through my defence yet?

Re: Court Claim Received - Please Help

I have just tried to log on to MCOL so I can submit my defence but I keep getting the error message saying 'claim no or password incorrect' - does this mean I am too late does anybody know?

Under response history at the bottom the claim number just says 'unsubmitted' - what does that mean?

      Thanks

'' Under response history at the bottom the claim number just says 'unsubmitted' - what does that mean?''

That's been happening a lot on MCOL recently - the court don't seem to know why - you can submit via email or on paper instead if MCOL is on a wonk. Should be ok date wise. If you email print the defence to a PDF and email with a cover note inc the Claim Number in the subject. If unsure give Northampton CCBC a call to check with them.

On the defence, I'd leave out para 4 unless you actually deny ever having had an MBNA card. As it is a credit card you just need to keep 78(1) and 78(6) in and leave out the 77(1) and 77(4) bits, also check couple typos on Drydens Fairfax name - I'd put 'Claimant's Solicitors' instead, otherwise it looks absolutely fine, very straightforwards.

Make sure you sign the statement of truth if sending electronically

Didn't you say the defence was due by 16th December though? I didn't get an extension in writing.

Ring court in the morning and tell them you have been trying and its not working, and ask them how to email it.

It's only 16th today. Default judgment doesn't happen automatically - the other side have to apply for it. Ring court in the morning explain the MCOL isn't working and you were trying to submit your defence, can you email it - should be absolutely fine so don't worry. xx

To log on to MCOL you need your Gateway Number XXXX XXXX XXXX and the password you submitted when you open the account,

I made the same mistake attempting to log in using the MCOL reference.

When you have logged in you will be able to retrieve your details.

Re: Court Claim Received - Please Help

On 17th December I received a letter from the court acknowledging receipt of my defence. The letter also stated that they would send a copy to the claimant and that they would then have 28 days to proceed. Does that mean to produce what I have requested?

I make 28 days from 17th December to be 14th January unless it is working days only - does anyone know?

If the claim is stayed what exactly does that mean?

I haven't received any further post from the court or claimant so wondered if there is something I should now do?

Thanks in advance for any help.

You could ring up the court and ask for a status update? See if the claimant has put in anything since your defence went in
