Hi All received a letter from Restons today. See Attached. I have emailed my defence but not sure what to do with this letter. Please help.

It's generic drivel from solicitors who think they law does not apply to them and can fob you off with rubbish like that. :rant: :rant: :rant:

If you have already submitted a defence as you say above, you can safely ignore that letter.

Hi All, I received letter from Restons today regarding my defence,see attachment. They are asking me to withdraw my defence or they will apply for my defence to be striken out. Also what do they mean when they say Legal costs to be paid on a 'contractual indemnity basis'? please advise as your help is always really appreciated.

but if you read back in the forums under restons it's not the first time they have tried this trick they really are the lowest of the low.
they really are bluffing its a small claims claim end off.
you continue with your defence and ignore that letter even though I know it must make you very angry.

This is a standard response from Restons currently, personally I would have sent a CCA request direct to Cabot.

Have you posted up the particulars of claim anywhere on the forum I think we need to see that asap.

The Particulars of the claim are as follows:
The Claimant claims payment of the overdue balance due from the Defendant(s) under a contract between the Defendant(s) and Lloyds Bank – Current Account dated on or about Oct 12 1995 and assigned to the claimant on Jun 17 2014 in the sum of ~#9918.09


Sorry that's all there is on the Claim form. I think they have intentionally not mentioned any notices or other documents so they don't have to produce them. Thanks for your help.

Is there any doubt that this is a current account?
Restons mention a contract, this document has not been disclosed as this is some 20 years ago I doubt it exists now.

For clarification when was this account last used?

You should also look up Foster-Burnell v Lloyds - and write a list of all disputes you have on the debt. Have they provided you with statements / details how the amount claimed has been reached ?

Hi again, I have received a further letter from Restons this week. Similar to their previous one asking for me to remove my defence. I would appreciate if you have any further advice of what I should be doing. Many Thanks
