Court Claim - arrow global / santander - 5-11-2014

    Hi,

    I have recently received a court letter saying I owe 200 odd pound to Santander ...s far as I am aware I have never borrowed off Santander ? It has given me 3 options; admit all the debt, admit part of the debt or to admit none of it. do I admit none of it ? The issues I have is that I do have a lot of old debt so it could well be that a card I had or something was actually owned by another company ? but as far as I know I genuinely havnt had anything of them directly.

    It also went to my Mums house, meaning the debt is over 6 years old - would this mean it would be classed as statute barred ?

    Any help you can give me regarding this would be really appreciated as at the moment I have no idea how to respond to it.

    I think eventually I will need to go bankrupt to get rid of these old debts ( the majority around 8 years old ) but I need to first get the funds to pay for it.

    Anyone ? Im also wondering if it would be an idea to call Arrow and see if they can give me more info re this debt?

      1. the claim is for the sum of XXX in respect of monies owing by the defendant on a credit agreement held by the defendant with Santander under account number XXXXXX upon which defendant failed to maintain payments

      2. a default notice was served upon the defendant and has not been complied with

      3. by virtue of sale agreement between Santander and the claimant who has a genuine commercial interest. the defendant has been notified of the assignment by letter

      I to my knowledge have never had anything with Santander ? No bank account, loans etc.

      As the letter was addressed to my mothers address I believe it to be statute barred but without knowing what it is for it is hard to know for certain

      I have made no action so far and wanted to wait on your advice as per my reasons above as I am confused as to what I need to do.

        How confident are you that these debts are over 6 years old?

        In this case you should acknowledge the claim straight away and that will give you a further 14 days to file the defence. You also need to send off the two requests for disclosure and they will flush out what this is about.

            Maybe Abbey National? Bradford and Bingley? Alliance & Leicester? Think Santander may have also issued some companies store cards?

              Santander owned a lot of store cards for a period e.g. Debenhams, House of Fraiser, Topshop, New Look etc. They typically had low credit limits of around £200 so my guess is it would relate to one of these accounts. You may not have known that Santander was involved as they acquired most of them from other creditors and didn't expose the Santander brand on statements etc until fairly recently

                Thank you for your replies. I did once have a Dorothy perkins store card but it was GE Capital I believe just looked it up and it seems Santander took over GE Capital.

                I took out the card in 2008 and believe that is also when I stopped making payments but it could well have been early 2009 (definitely no later ) so theres a chance it is a couple months away from being SB :/ What do I do in this circumstance ?

                      Tick intend to defend in full, that just serves to extend the time you have to reply to the claim to 28 days from receipt It isn't binding so you can change your mind later and admit if you feel that is best, but get the requests for information sent off and see what comes back first.

                        Ive just enrolled and now at the part where I haave said I am defending all of the claim. it is asking my reasons why. Do I put because I believe it is SB or that I do not recognise the claim ?

                          Acknowledgement of service does not ask you for reasons for the defence at this stage as far as I know?

                            Could you screen shot the page from moneyclaimonline ( as we can't get in unless we have a claim number and password ) - and they do keep changing it. It should just be a tick box to acknowledge receipt of the claim, and no more info is needed as Nibbler says.

                              I had accidently started a defence but I have deleted that now and have now acknowledged the claim. So now do I contact Arrow and ask them for additional info ? Thanks for all your help so far
