      You've done right putting the defence in. If you've still had nothing from the claimants then you should be okay. 28 days now to see if they respond to the defence xx

            I have exactly the same going on with Arrow/Drydens. They issued a claim in Nov 2014, I acknowledged, sent a CPR31.14, filed my defence.
            They have not responded within 28 days (now at about 50 days). Court told me the case is stayed. They can only get that lifted by a district judge, and the claimant would be notified if this was the case, so they can't just spring a surprise judgement on me without me knowing.

            So, you can leave it a little longer (advised), as courts do have backlogs, then apply to have case struck out (fee either £50 or £155) on the grounds of abuse of process (i.e. they should have had the relevant documents prior to commencing the case, and still could not provide them when asked). You should firstly write to them advising of your intention to strike and reclaim your fee, at which point they may drop the claim altogether. It is up to you.
