Hi,
after a lot of thought i am pretty sure i have made a payment on this credit card account, would be best to make a offer for monthly payments, if so which is best i.e. on the court means test form, and send it to them or the court, or should i not use the court form and just ring drydrens up.
what do you think....

In that case, I'd wait to hear from the court before doing anything else. :ranger: The claimants have 28 days to tell the court whether they wish to proceed with the claim or not, if they don't respond the claim is stayed. You never know, they may not be in possession of documents...

well hi there all,
hope you all had a lovely chrimbo,,. Just wondering what next, as i heard nothing from the courts, solictors or lowels, the issue dates on court papers was 5th nov, for claim and 11th nov for another, does this mean they are not bothering, was wondering is the 33 days working days, or does it include weekends.

i haven't done anything, just got a letter from court informing me that solititors
have 28 days to inform court if they wish to proceed, and they will let me know if they do,, that was early nov. heard nothing since from anyone.

Good morning,
I would recommend checking your credit files, Experian and Equifax have 30 day free trials, (cancel when you have your report otherwise you will get an auto subscription).

Check the start date and default date on the entry (if it's still there, All defaulted accounts are removed after 6 years have elapsed from the default date.)
If there has been no payment or unequivocal written acknowledgment of the debt within that 6 year period then you are on safer ground with your SB defence.

oh dear iv' messed up,, i got a ccj, however its not the end of the world,, but the problem is i cannot pay it,, my husband is not working at min, i am on low pay, already in arrears with rent, ni insurance and water, so do i ring drydens or the court,, PLEASE HELP,, also can drydens act straight away with the bailiffs. that is my main big worry, as my husband does not know....

hi, it was for a credit card, and the claim was from arrow global,/ drydens for 3,000, i got confused, i knew it wasn't staue barred so did not put in a defence.i didn't think there was much point,, .quack quack oops!!!

What is the Lowell Carter case?
Can you tell me the terms of the judgement order please?
Is payment to be made forthwith or by instalments?

ok, the lowells carter case, is a different one, i filed a defence for that in nov and the 33 days has passed and not heard from anyone, the arrow global the judgement is forthwith and not instalments,,, what do you think i should do...

Are you able to make any sort of reasonable offer (affordable by you and acceptable to the claimant) so that you could apply for the order to be varied?

yes i suppose, but what is reasonable and realistic, it would only be a 2 figure monthly payment. and would i contact drydens or the court.

It is worth noting that for many DCAs not having the documents is not a bar to attempting to scare the defendents into a settlement.
