    I found the CPR request template at the end of a Google search on an online forum, cannot remember which forum it was unfortunately. I was another Cabot Claim though - there are loads!!

    Should I make the CCA request simultaneously? Is there a template?

    Really appreciate the help, getting worried about that date for submission of the defence drawing closer!

      Yes you should get one sent off in the morning too, if they disagree with the extension we'll wing it a little bit on the defence but it'll be okay.

      You will need to POST by recorded mail and enclose a £1 postal order or cheque direct to CABOT

      CABOT will write back and say it takes 40 days.

      Don't mention to Restons you haven't sent it yet, hopefully they will just assume you have and CABOT have said 40 days like usual.

        Can you tell me a bit more about the actual debt too please ( do the CCA letter and email to restons first though)

          Thanks, feeling well looked after here. I will get on top of it first thing in the morning. Can't find an email address for Reston's on any of the correspondence but will call the direct contact first thing in the morning and advise accordingly. Will send off the CCA request and the reply letter to Restons by 1st class recorded post in the morning.

            All good, just read your post. Will send the CCA request to Cabot and not the other reply to Restons.

            Original loan was a sofa from DFS, made payments for a period and then hit hard times and stopped paying. Unfortunately don't know the date of the last payment but could well be past the 6 year mark. Have never replied to any correspondence or other contact from Cabot or any other party. Have only ever made any payments prior to default and only by direct debit to the original loan.

                The claim forms states that the contract was made 25/07/2006 - sounds about right but not really sure.

                I am on top of this as a first priority - have a few CCJs that expire the middle of next year (I dug my head in the sand at that stage and never defended them) so really looking forward to a clean slate and a new beginning - cant let this break that.

                  Okay, so years free credit maybe, then start paying for a year, so could be July 2008 ish for last payment.... it is a possibility.

                  Ref not getting another CCJ when you're so close to being free, if it comes to it are you able to negotiate a payment arrangement out of court? or even a full and final of something like 50% of the debt ? ( Just in case of emergency that is)

                    Short answer to your question - yes - if my hand is forced will do whatever it takes to avoid the CCJ

                        Just called Restons and had an incredibly aggressive and unpleasant conversation with the lady dealing with this claim. I advised that I required an extension to submit a defence as I was waiting for the credit agreement from Cabot and did not have all the fact necessary to file a defence. The lady asserted that the agreement and terms would have been presented at the time it was entered into 8 years ago and therefore was not required at this point. I told her that was not the case at which point she became very aggressive and stated I had no grounds for an extension and it would not be granted. I asked her if I could please have a written confirmation of the refusal to grant an extension, initially she refused this, but after insisting that she give me an official verbal confirmation of her refusal to issue a written confirmation of the denial she stated she would send a letter. The call ended viciously with her making some unpleasant comment about awaiting the defence, I nicely thanked her and advised I would be waiting for the letter.

                          Good gracious, there is really no need for them to behave like that at all. I'm sorry you had to go through that but you sound like you more than held your own and good thinking getting refusal in writing.

                          So we best get on with the defence then I'll get a coffee...

                              There is a reason why the S (3rd letter) in their name sometimes gets mistyped as a C, and the ON as a UM.

                                I am telling you not many people would have held out under that pressure. I wish I had a full transcript, she was constantly twisting what I was saying and accusing me of contradicting myself when defending myself from the twisted accusations, unbelievable. I had to tell her more than once that we were not in the court room and I felt no necessity to defend the claim on the phone, only to request an extension under my right to more information needed to present a defence. Have a new found bad impression of the industry as sharks, perhaps unfairly based on a single initial interaction with one person.
