    I have recently received a claim (Restons Solicitors Limited for Cabot Financial (UK) Limited for Hitachi Nova). I have filed that I intend defending and have forwarded a CPR 31.13 request. Today I have received a reply from Restons effectively denying the request. I would appreciate any assistance anyone can offer, is there a paid service where someone can help deal with this on my behalf? Any help appreciated. Thanks

    You don't need to pay for help, if they have refused to comply with your CPR request you can respond with this: http://www.legalbeagles.info/forums/...385#post410385

    Would be useful if you told us how much the claim is for and a bit more details about the account, when did you last make a payment, when did you open it, etc. :typing:

      Thanks for your reply and advice. According to the claim form the date of the contract was 25/07/2006 in the amount of £1598.40 (fees bring it up to £1783.40). I have no records as do not know the date of the last payment or the accuracy of the contract date. I will reply to the refused CPR request letter today but need to file my defence in the next few days. Can I file a defence stating that I cannot file a defence without the docs requested under the CPR?

        Did you also send the CCA request to the owner?
        Without all the details its difficult to advise on any claim.

          I sent the CCA to The court, Cabot and Restons. Restons replied very quickly. Can I post images of the letters on the forum obscuring personal details?

                              Rightio, I would rather you got an agreement for an extension than put in a defence based solely on a CPR request.
