        I have had a `Notice of Proposed Allocation to the small claims track (N149A) stating I have until 10th Nov to complete if i decide this is the appropriate route to take.

          I suspect you sent it to the court or you'd never have got to allocation.

            I returned `the acknowledgement of Service` to give me an additional 14 days to prepare my defence. My defence is now prepared but NOT sent in as I`m still not sure whether to follow this route or the small claims track. My instinct tells me to put in the defence which, considering the last Judgement against CEL in February, stands a good chance of winning the day - should CEL turn up!

              You are actually very late with a defence. Without one i'm surprised you got to allocation.

                Not sure what you mean by an `allocation.` I am now completely and utterly baffled by the whole proceedure, to the extent that this morning I sent off my defence to the CCMCC and am just going to take it from there because frankly I am p....d off with the whole thing, when I know that CEL will probably not even bother to turn up. Why in G...ds name do they keep sending out these claim forms. OK, two thousand plus, a certain percentage will cough up. Happy days! Many thanks for your help Mystery.

                  In the court system a case is allocated a track. Small claims are under £10000 and then fast and multi track as the amount goes up. This dictates the rules you play with . Nothing major, just procedure.

                  Acknowledge Claim - within 14 days from Service

                  Defend Claim - within 28 days from Service (IF you acknowledged in time)

                  If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
