  • Court Claim - Marlin / Egg - 25-9-2014

    Ive filed a defence and have requested a CPR and CCA from claimant & solicitors , from following threads on your forums. However I have not received any replies back from these and my 28 days run out on 23rd October , as the date of service is 25th September ( although I did not receive the paperwork until 3/10/14)

    Any advice on what I do next would be gratefully received

          Amount approx: £8712.65
          Claimant: Marlin
          Solicitor: Mortimer Clar
          Original Credit: Egg

          Particulars of Claim:
          By an agreement between Egg & the defendant on or around 19/11/2044

          ("the Agreement")EGG agreed to issue the defendant with a credit card upon term and conditions set out herein . In breach of the Agreement the Defendant failed to make the minimum payments due & the Agreemnt was terminated. The Agreement was assigned to the claimant on 31/01/2013.

          THE CLAIMANT THEREFORE CLAIMS:
          1. 5649.48
          2. Interest pursuant to section 69 of the County Courts Act 1984, namely 2553.17& continuing until judgement or sooner payment at the rate of 1.24


          Stat Barred?

          Have sent: Acknowledged the Claim, Sent a CCA request, Sent a CPR 31.14 request

          Other Info:
          Not Sure if it is Statute Barred , but don think so

                    Morning Sounds like you have done all the right things so you should be okay working from the basic defence example shown here http://www.legalbeagles.info/forums/...t-Court-Claims then post up what you have for checking and send me a pm and I'll take a look.

                    Am I correct in thinking you have had no documents back from the claimants from your requests ?

                      Hi Amethyst

                      Thanks for your input, you are correcting in saying I havent received any replies. Aon a secondary note; does my defence have to be filed today as the court issue date is 25/9/14 , however I seem to see threads on here saying 33 days from receipt, how do you prove receipt ? Probably not being the sharpest
