  • Lowell/BW Legal/Nationwide Account- Help needed

Afternoon I have received a claim out of Northampton county court ( Details below), I think the claim amount is made up almost entirely of added bank charges from what stemmed from going overdrawn by around £20. I have acknowledged the claim and intend to send BW legal a CPR 31.14 letter today, any further advice would be appreciated.

    Issue Date: 25 Sept 2014

    Acknowledged on 09 Oct 2014.

    Claimant: Lowell Portfolio 1

    Address for documents: BW Legal

    Signed by : Alison Duckworth

    Particulars of claim:

The claimants claim is for the sum of £288.89 being monies due from the defendant to the claimant under a financial services agreement regualted by the consumer credit act 1974 between the defendant and Nationwide building society.
Under account reference xxxxxx913 and assigned to the claimant on 22/12/2010 notice of which has been given to the defendant.

The defendant failed to maintain the contractual payment under the terms of the agreement and a default notice has been served and not complied with.

The claim also includes statutory interest pursuant to section 69 of the county courts act 1984 at a rate of 8.00% per annum (a daily rate of 0.06 from the date of the assignment of the agreement to the date of issue , being an amount of 21.96.

    Amount Claimed: 288.89
    Court Fee: 25.00
    Solicitors Costs: 50.00

    Total amount: £363.89

Any help would be greatly received

    Regards

Hi Blacksheep, so sorry to have missed your posts xx

You've acknowledged the claim and sent the CPR request. It's a current account and you feel it is mostly overdraft charges.

Would you happen to still have any of your bank statements from the time the charges were imposed ?
