    Issue Date: 15-10-2014
    Amount approx: £5408
    Claimant: MKDP LPP
    Solicitor:
    Original Credit: Barclaycard

    Particulars of Claim:
    Barlaycard have sold the debt onto MKDP LPP in Sep 2013, at this point in time I was contacted by MKDP informing me of there controlling the debt. I then began the process of asking for original documentation including copy of signed credit agreement, deed of assignment etc. Once they could not provide this info I then placed an Estoppel notice in Jan 2014. After this I have received no comtact from MKDP until today (15/10/14) where I have been issued county court claim forms for the amount.

    Stat Barred? No

    These are not the particulars of claim, that would be the text written in the large box on the left hand side of the claim form you received.

    Sounds like you've been following the 3 letter system from a well known site, sadly that method doesn't really help when they take you to court.

    When was the last time you made a payment? When did you take out the card? Did you apply for it online? Anything you can remember about when you applied for it can help!

      Your first step should be to acknowledge the claim, which you can do online. :typing: You should do it within 14 days. Tick the box that says you intend to defend in full. :thumb: That should give you a further 14 days to submit a defence. You have a total of 28 days + 5 allowed for service, from the date on the claim form. :clock:

      So, first steps (within 14 days of receiving the claim)

      1: ACKNOWLEDGE THE CLAIM - you can do this online usually at www.moneyclaim.gov.uk
      You'll need your claim reference and password from the front of the claim form

      2: Send A CCA REQUEST to the CLAIMANT ( see here )
      This applies to all credit cards / loans / hire purchase / store cards type debt. It doesn't apply to Mobile Phones / Utilities or Overdrafts.


      3: Send a CPR request to the CLAIMANT'S SOLICITORS ( see here )

        Just to add to what Flaming Parrot said, do NOT use the arguments from the ''three letter process'' in your defence. Follow FP's advice above.

          I am in the same situation over an overdraft with Halifax, it has been defaulted in 2010, and received court papers today from a DCA. The problem I have is , on the bank statements it says "arranged overdraft" but I never requested one or applied for one. I have received a letter from the bank years ago saying that the debt has been passed onto an DSA ( different than the one that send me the court papers) and nothing else. Will it be worth trying to get the claimant to send me a proof of this debt and take things further or not?

              Defend Claim - within 28 days from Service (IF you acknowledged in time)
