  • Help with Restons solicitors

    Hi thanks in advance for reading this. I recently had a CCJ registered against me from restons solicitors. The date of the ccj was the 29th August. I spoke to the courts and they stated that if the judgement was paid in full by the 29th of September then it would be cancelled, I had to move some money around and paid the money on the 29th of September by using our current account and credit cards. Restons then sent me a letter stating that the debt had been paid in full an within the calendar month, I confirned with the court that this was still ok and the judgement would be cancelled, again they agreed.
    Restons then sent a data file to the court that states they received the payment on the 3rd of October, their rational is that because it was paid on a credit card it did not hit their account until the 3rd October even though on all my statements it says the 29th September.
    After speaking to restons they have said that they will send a letter to the court stating what has happened, obviously I do not trust them.
    What I have done is emailed the letter from restons to the courts and sent Restons a SAR. I am really stuck on what to do next?

          It does sound like you have done everything you can do. If you are concerned that Restons won't have done what they say they have done then give the court a call to see if they have received anything from Restons and to confirm that the CCJ is being removed from the register.

            The issue is that Restons said right from the start that the data file would say that it has been cleared in full on the 29th, but what they sent in the data file was that the debt was cleared on the 3rd October, the 3rd October would not get it moved from my file. I also do not trust the letter that has been sent to the court. I am extremely worried about it not being cancelled as I am about to apply for a mortgage.

                Okay you might have to give it a couple of days for Restons to get the letter to the courts.

                Do you have evidence (on your c/card/bank statements ) showing the date the money was paid ? If Restons don't do as they say then you can use that evidence to show the courts the amount was paid within the 28 days and should be removed from the register.

                  Yes it clearly shows the date on my bank and credit card statement.

                    Perfect.

                    Amending a CCJ record

                    Defendants who feel that details of a registration are inaccurate, may apply to RTL, providing particulars of the judgment and stipulating the required amendment. If no up-to-date search of the relevant section of the Register has been undertaken, the requisite search fee must be enclosed.

                    The query will be raised with the court who will investigate and respond to RTL. Upon receipt of their response, any appropriate amendment will be made to the Register and the defendant advised.

                    The credit reference agencies will be notified of any satisfaction/cancellation or amendment and their records are normally updated within a week of the notification.

                      I have just spoken to Restons and they have sent the letter, they then respectively asked that I stop calling them. The court have now reported it to the trust online that it has been cancelled. I am so happy as we are about to apply for a mortgage.
