  • Court Claim - Capquest Investments 2014 / Orange - 10-10-2014

    I am in a similar position with no default notice. I have read the thread fully and I am going to attempt to do what you suggested in the thread. I received my CCJ claim form today 5 days after it was issued leaving me with 10 days to respond.

    I have printed out the CPT 31.14 letter to sent to the law firm on the claim form. Do i also send this onto the court? I am also unsure as how to fill in the form regarding the defence. I understand from the thread I need to put I wish to defend myself. (I intend to defend all of this claim) but I am unsure as what to put on form N9B with regards to the reason for disputing the claim.

    The alleged claim is for a very round £300 for an old mobile phone contract from 2009 and there is no supporting evidence sent with the claim form. I have received no notice of assignment or default notice to date. Added to this are court costs of £25 and solicitors fees of £50.

    I would like to know what the £300 is for exactly,

    What am I able to do and how am I able to do this?

    The contract I had was with Orange and not Everything Everywhere - where do I stand with that?

              Also the claim says the money is owed to Everything Everywhere and not orange who the contact was with. Does this matter?

                Hello all

                I was issues the above paperwork on 10/10 this year and sent a CPR 31.14 request. I have had nothing back yet from the legal people handling it except a letter saying Capquest would accept half the balance and that the offer was valid 28 days from the letter. If I paid they would stop the claim. What do I do? Do I send notification back at the 11th hour saying the CPR 31.14 hasn't been responded to?
                Any help would be appreciated as I am now running our of time with only a matter of days left,

                  I'm Sorry to have missed your post up until now.

                  I think Orange turned into EE so I believe it is the same company.

                  As you have had no response to your letter, and as the amount is ''only'' £350 I would just submit a defence stating something like...

                  I deny the claimant is entitled to the relief as claimed, or at all. The Claimant has sent me no information on how the debt has been made up and I am unaware of any sums owing to the original creditor. As far as I am aware I have never held any contract with Everything Everywhere. I have never had a default notice or a notice of assignment from either the original creditor or the Claimant. I have previously sent a letter to the Claimants asking them to provide me these details as allowed under CPR 31.14 but they have failed to respond. I would like to put the claimant's to strict proof that I am liable for any sums owing on the account claimed upon, details as to how the sum claimed has been calculated, evidence that the claimants have been legally assigned any account that existed and proof that that the original creditor had sent a default notice to me.

                        Thanks so when would you advise I send the info to the court bearing in mind the time constraints? I would like to try and do it so the legal side cant reply in time. If I submit the above statement then what in your opinion could happen next?

                          Also regarding proof they sent the default notice to me would that in the eyes of the law mean tracking proof that it did get to me rather than just a print out of a letter? I have the tracking info for the CPR 31.14 that I sent to them

                            Wouldn't be 'tracking' as there is no requirement to send a DN by recorded delivery so it will just be a reconstruct of the letter with the right dates on,
