Re: Court Claim from Bryan Carter for Lowell Portfolio

Evening forum users. Good news in the post this morning. Received a letter of Discontinuation from BC. A lot of stress and worry for nothing. How do these scum bags get away with it? Thanks to all those who gave invaluable help and advice on fighting this.

Thanks for all your help Nem. One question I do have is, now that the claim is discontinued can I know try and claim back the unfair charges and PPI payments on that account, which was what I originally made a complaint about and set-off in my defence?

Hi Andy,
your thanks are much appreciated!!

Yes certainly start a reclaim of the PPI first I think as it will be a greater amount than the charges.

Hi Nem, that’s okay. Without your help I would have probably crumbled under the pressure that BC were trying to put me. It just shows that it is very much a waiting game and never show your hand until you are completely sure. With the PPI do I claim this through Lowell, or go back to Welcome?

It feels like a case of David vs Goliath. These people think they can intimidate, scare and bully us into submission. But if we keep fighting back this encourages others in the same position to do the same.

PPI has to be reclaimed from the origin a lender who mis sold it in the first place rather than the debt purchaser - Lowell wouldn't have anything to do with it. You may want to start a new thread in the PPI area of the forum. :typing:

Well done beating the Lowlifes, goes to show it can be done! :high5: :high5:

hi 2708andy. Yes I completed N180 way before 15th Jan deadline and agreed to mediation and sent recorded delivery letter demanding proof of alleged £1 one off payment 2 weeks before that. From receiving Directions questionnaire 7th january I have heard nothing from BC, Lowell or court! Not sure if this is the norm but my nerves are shot!! so so pleased you got a result. Must be such a weight off your shoulders! well done for seeing it through and what would we do without the fab people on here?? especially amethyst and nem? x

Hi,
It sounds like the claim has been stayed.

A quick call to the court to confirm this is your next step.
