      UPDATE

      ok I've received a letter from Northampton court dated 3rd November. It's headed "notice of proposed allocation to small claims track" it says I must complete the small claims questionnaire (form n180) and file it to the court office before 20th November.

      does this mean the claimant has responded that they wish to purse the case further?

          Thanks, I will get it filled in and sent Monday or Tuesday next week.


          no sign of CCA or any documents, I have received nothing. I sent the last letter you suggested but it arrived 4th November so they would have already made the decision to proceed by then.

            Does this mean the case will 100% go to court? Will BC likely send someone to the hearing?

            Could a ccj be obtained without a CCA? If they do have a CCA surely then they have withheld that information from me.

              Also do I need to submit any documents to the court with the n180? Copies of letters sent to BC etc? Also could I attach a letter requesting that the judge order BC disclose all relevant documents for me to view prior to this hearing?

                UPDATE

                the court have confirmed they have received my n180 and I have also received a copy from Bryan Carter. Bryan carter have still not supplied me with any documents, they attached a letter to there n180 and stated they still wish to settle this before court, also they stated in there n180 that they would not have anyone appearing at the court hearing.

                Should I respond to bryan carter or should I ignore them now until the court hearing?

                  That depends on whether you wish to make an offer of settlement or not. If you don't have that intention, there's not much point in contacting them at this stage.

                    The Court will send directions to both parties, this will include a requirement to exchange relevant documents: http://www.justice.gov.uk/courts/pro...es/part27#27.4
                    Preparation for the hearing

                    27.4
                    (1) After allocation the court will –
                    (a) give standard directions and fix a date for the final hearing;
                    (3) In this rule –

                    (a) ‘standard directions’ means –
                    (i) a direction that each party shall, at least 14 days before the date fixed for the final hearing, file and serve on every other party copies of all documents (including any expert’s report) on which he intends to rely at the hearing; and

                      No I don't want to make an offer, I didn't know if I should respond reminding them again that they have yet to provide me with any documentation including a CCA.

                        UPDATE

                        ive had a letter from the court stating the hearing will go to small claims on March 26th 2015 and claimant has to pay by January 5th 2015 if they wish to proceed.

                        as yet I have received no documents from bryan carter or Lowell. Is there anything I should do now or just wait to see if bryan carter pay and continue to a hearing.

                          I would leave until just after the new year then chase the documents as any communication is likely to go missing at this time of year!!

                            Ok I'm going to start preparing any documents to send to the court, I just need some help with this.

                            The court papers say I should contact them now if I wish mediation, what exactly is this?

                            i have no supporting evidence as such regarding my case as BC and Lowell have supplied nothing, all I can submit is my letters requesting documents which they failed to supply.

                            do i need to include a cover letter to the judge explaining no documents have been supplied etc?

                            finally I will need to take a day off work to attend the hearing, if I win the case could I ask for costs due to the time off work etc?

                            I need to send copies of all supporting documents to BC, anything I don't include now won't be excepted in court. Just want to make sure I don't miss anything.
