    Was this card in joint names originally ?

      Yes it does say to send any documents to the court 14 days before.

      I am sure my debt is statute barred despite what the claimant says.

      I will try to post a copy of the CCA

        Hi just to clarify:
        Statute Barred (England & Wales) [simple contracts] 6 clear years no payments (from any source or to any party) and no unequivocal written acknowledgment of the debt.
        6 year clock started from the date a contractual payment was due and not made, after which no further payment or acknowledgment was ever made.

                So as my court date approaches (13th March), please could someone help me with what sort of documents I should be submitting. Is there a form I need to fill out? What sort of documentation do I need to send in 14 days before to support my statute barred case? Clearly Lowells are intent on pursuing this debt - and so the sleepless nights begin............ Someone's help/advice would be very much appreciated.

                  Are you going ahead with the statute barred defence?

                  {f so have you found anything to support the defence? Although it is for the claimant to prove otherwise it is obviously beneficial to have some tangible backup.

                    Yes I am going ahead with SB defence. I have all the statements from the credit card company and all the statements from my current account. Presumably I just take a photocopy of all this and send a copy to the courts. Do you recommend any other documents?

                      Ok so it is upon the date of the " last payment which you intend to rely on in court?

                      If so highlight the payments on the copies of the statements and in particular the last payment ever made.
                      These will have to form part of your "bundle" and be marked a an exhibit e.g. item 1 in the bundle, anything
                      else you have to support should be set up in the same way.

                      you need 3 copies of all the documents 1 set for the judge, 1 for the claimant and 1 for you.

                        Ok 3 copies. I don't really have any other documents. Are the claimants likely to pull out before the court date? Do SB cases generally do well in court?

                            SB is absolute, a lot of idiot thieving bxxtxxxs of debt purchasers (scumk of the exxtx, try it on to the end to see if you back down, as they make a lot of money out of people who get scared, it is criminal like a lot of so called justice (non) in most cases.

                              Have the claimants said they don't believe the agreement is statute barred ? or responded to your defence in any way other than just sending the N180 and Tomlin order offer ?

                                That may be where they make an argument and say you have made a £1 payment/acknowledgement of the debt so you should sort out your argument against that, just in case.
