    i have just received an email from mortimer clarke apologising for not answering my letter re the cpr request and saying that they have been instructed by cabots,their client, to place the account on hold .
    Cabots are agreeing to a 28 day extension to give me time to file my defence .Pursuant to cpr 15.2 they are asking me to notify the court in writing of the agreement.

    Having already filed my defence what would be the best advice for me now please .
    do i write or email the court accepting the extension or if I do nothing what would happen ?
    could I even make an application for the claim to be struck out ?

      Thank you for your email, which I received Thursday 9th October at 3.30pm, indicating your clients agreement to an extension to the date for filing a defence in this claim under CPR 15.5.

      As you will be aware my defence is due today and as such was submitted to the Court on Thursday 9th October at 10.00am.

      Therefore I will be unable to agree to the proposed extension.

      I enclose a copy of my defence for your reference, although the court will be sending a copy to you in due course.

        Thank you ,just wanted to be clear on whether or not I needed to contact the court ,I've no interest in it being delayed and will look to see when the date is set . Copied it to Cabots as well as they do seem to have communication issues with each other .

          Update ,still awaiting a reply from cabots re this ,it was placed on hold pending investigation . My MP wrote to cabots CEO to ask why they were pursuing in view of the banks comments regarding enforceability and my own financial circumstances .

            First off , apologies for absence but been recovering from a serious illness.

            UPDATE

            Cabots instructed their solicitors to cease all action on this account having come to terms that court action was futile based upon the banks admission that lack of a properly executed cca prevented enforcement

              Congratulations on getting them to back off. One less stress to deal with. You should probably check with the court that all has been discontinued.

                Hi thank you ,had court confirmation of it as well !
                Yes,on the mend now thankfully,gladular fever compounded by a virulent blood disorder and been in and out of hospital the past 6 months.

                  Glandular fever knocks you for six, let alone with the rest of it, sounds like you've had a rough time of things - don't push yourself too hard - at least this is one you can forget about now.

                  You had quite a few others which couldn't get their paperwork in order didn't you, are all those still quiet ?

                    have a couple i'm playing bat and ball with but i believe they;re all statute barred now ,one with lowell and the other aktiva /prc
