      Hi All/Amethyst.

      I submitted my set aside order yesterday. But I made a few errors and hope someone can tell me how to correct them . Very sloppy:

      The numbers for the paragraphs that I wrote in my witness statement are wrong.

      I've done: 1, 2, 3, 4, 5, 6, 7, 8, 6, 7, 10

      I am so frustrated with myself. I am also concerned now that I signed the Witness statement and draft defence...as they will get my signature from this?

      I also imformed shoosmiths that ive applied for the set aside order. They asked me what my defence was and i refused to discuss. They said that a letter was in the post in response to my CRP 31.14 request (very quick as they only received it on Friday). He then said that if my defence was based on no evidence of a default notice, that they have it registered on their system and that's good enough. I didn't respond.

        Okay, sounds like you are having a panic wobble :0 Really don't worry, getting the numbering wrong won't invalidate your witness statement.... and despite what people seem to like to tell others, it's not actually common, or particularly necessary, for creditors to lift signatures off court documents to paste on fake credit agreements xx

        Just a case of thumb twiddling till you get something back from the court, or of course this letter from shoosmiths (likely refusing to give you any documents under CPR) Interesting Shoosmiths mentioned default notice though, they might actually have sent you one.

          Though I don't recall ever receiving a default notice...so I guess we will see.

            Hi All/Amethyst,

            Well, this is going badly

            Yesterday I received my set aside application back as remission was refused. I was intending to resend it with payment on friday.

            However today I've received a response from arrow in regards to the CCA request.

            Surprisingly it shows 3 loans taken out

            first in 2004 (signed), second in 2005 (online ticked box) and the 3rd one in July 2007 (signed)

            I certainly don't remember taking the loan 3 times but...

            Am I correct in assuming that because of the July 2007 one there is nothing for me to defend?

            I've tried to picture the documents but the writing is too small..I will go and photocopy tomorrow.
