              Hi (Amethyst),

The CCA has been sent (unsigned). I didn't manage to print out the other 2 forms (but will be able to over the weekend)

Thank you for all your help and support so far.

That second letter is a bit naughty, as they don't mention it would be a judgment by default and that you have to acknowledge and have the opportunity to defend. Tsk.

Seems like they can do what they want and they didn't waste any time in this process...

Should I be working on my witness statement now?

                    Hi Amethyst??

I'm abit stuck now to be honest, and other advice seems to suggest that I would not be able to get the judgement set aside as I have no paperwork.

Really would appreciate hearing from you.

                    thanks

If you don't apply for the set-aside then you will get hit for the full amount, so you need to do this asap.

The issue of the JSA is just to get the set aside fee paid for you. What happened at your meeting yesterday and can you get evidence of the application and know when it will be decided? If you can give a clear indication of this then you could inform the court of the immediate problem and ask if they can allow a little extra time for filing the set-aside, but you would probably need to give them some clear indication of timing. Can you sort this with the Jobcentre?

                              Hi Kafka,

I've received this advice from another forum. That because I have no 'real prospects' of success at trial that it's unlikely that my application will be accepted (to set aside). and that all i am effectively asking for is another chance to respond.

I have no paperwork (to deny the claims) and cant state any facts for sure. All I know is that I wasn't available to read either of Shoosmiths letters, nor was I in a position to acknowledge the claim before default. (sounds like this may not be acceptable though)

As for the JSA I'm due to go back later, so hopefully I can have some information on this. That aside, If i had confidence that there was a real prospect of me succeeding, I would find a way to have the fee.

                              Thanks so much for replying
