  • Please help! CCJ claim from Akinika Debt Recovery

    Hello


    Can anybody help please? Today I received a letter from a company called Akinika Debt Recovery advising that Arrow Global had handed my account to them.


    They are claiming that I owe the over £3000 and that a ccj was issued against me in July 2009, I think this may be for an historic catalogue debt but am not sure?


    Long story short, I got into some financial difficulties 6/7 years ago (largely thanks to my ex husband!) and I have paid some debts off and some are/ almost are statute barred.


    What should my first course of action be? If this company is correct in saying a ccj has been issued against me, am I correct in saying that this debt will never become statute barred. So should I try to set up a payment plan?


    Any help would be much appreciated. I am fairly new on here so also am I posting in the right place?

    Hiya, and welcome.

    Okay first thing to do is check if you do have a CCJ against you and how they got it without your knowledge and then waited 5 years before doing anything about it.

    Yes a CCJ doesn't become statute barred - they have to make enforcement action within the six years though or go back to court for permission - which will be why they've surfaced now.

    Check your credit file firstly (maybe with Noddle as it is free) or check yourself on the Registry Trust site http://www.trustonline.org.uk/search-yourself

    Had you moved house since defaulting on the account and June 2009 ?

    Do you recall what the original catalogue was and when you opened the original account ?

      Thanks so much for coming back to me! I have moved house, almost 4 years ago. I've had several letters at my new address from DCA's which I've just ignored (head in sand!) however in the last year I have been trying to deal with any outstanding debt.

      I have just checked with trust online and to my shock I have 2 CCJ,s registered against my name, while I was still living at my old address. Basically my ex husband was hugely in denial about our debt back in 07/08 and hid all my mail! This only came to light when I moved house in 2010. Both judgements show they were issued at Northampton CBBC?! One is dated 14/07/09, presumably this is what Akinika are referring to, however I cannot see what they are for or who the original debts are too.

      Help!! I think this May refer to a Littlewoods account and it will have been opened somewhere like 2001/2.

        Thanks for that, sorry you've got a shock, but at least you can start dealing with these things.

        Would you be able to take a picture / scan in the letter that you received from Akinika please (or type out the pertinent bits) then we can sort out writing back to them.


        Who's the holder of the second CCJ or are they both with Arrow ?

          I don't have a scanner but I can give you the pertinent details of the letter. They give the date of the judgement, amount outstanding and that their client is Arrow Global.

          The rest of the letter says:

          We are instructed by Arrow Global concerning a debt due to them, Arrow has obtained a CCJ against you on 14/07/2009. The States balance due.

          Our client does not want to pursue further legal action and instead would prefer to reach an affordable monthly repayment arrangement with you. Please contact us as soon as possible to discuss the various repayment options available to help you repay this debt. To help us understand your overall financial position and to determine how much you are able to pay each month, we have enclosed an income and expenditure form, which can be discussed via telephone or for you to complete and return to this office.

          It is extremely important that you contact us to discuss your situation, we can only assist/resolve this matter if you get in touch. A settlement may be available, subject to affordability. (End of letter).

          i don't know who holds the other ccj as the report doesn't give this information, although I think it is a dca called the Lloyd Group, who I have had a payment arrangement with since 2010 (pay every month and never missed a payment) and have about £1000 left to pay, was originally for a goldfish/Morgan Stanley credit card.

              It does sound as though setting it aside wouldn't be an option due to the circumstances of the claim and length of time, so you would be best off sorting out a payment arrangement with them, or if you can, negotiating a full and final settlement.

                  Thanks amethyst should I write to them acknowledging the debt then and offer what I can afford to pay? Do I send it recorded delivery too? I am about to go on maternity leave so it won't be much, hopefully when I'm back at work I can up the payments and get this cleared.

                  as a matter of interest do you know how I can find out whom owns the other ccj?? Thanks again for your help

                        I would reply to them firstly asking for more information about the CCJ, as it isn't clear what it is for, and they are not listed as the claimant on your credit file or the registry trust.

                        Something like.


                        Dear Sirs

                        Thank you for your letter dated xxxxxxxxxxx regarding a County Court Judgment obtained against me by Arrow Global Ltd. Your letter is the first I have heard about any court action being taken against me and therefore I would be grateful if you could give me further information regarding the claim and the debt. I have checked my credit file and the Registry Trust Online but the information given there is limited.

                        I am sure you can appreciate your letter has come as something as a surprise to me and I would like to sort out an arrangement to repay any legitimately owed debt however as I had no notification of a court claim, judgment, nor any contact with Arrow Global previously, I do require further details to enable me to take advice on the matter.

                        I look forward to hearing from you.

                              Just thought I would update with this and wondered if you could offer any more help? I sent the letter asking for details (as above) just received another letter saying same thing not even acknowledging the first letter and request for more information.

                              Sent another letter (signed for) asking once again for more information and received a letter back stating the date the CCJ was obtained and the last date of payment to the account (£20 by debit card in October 2008), doesn't say to whom or what this is for!

                              Dont know what to do next.? Not even sure if this agency really owns the rights to collect this ccj? Their information seems sketchy? I do want to pay off any legitimate debt owed but the lack of information is making me wary?

                              Any suggestions of what I should do now??

                              Also Kati I can't seem to start a new thread, for the other advice I was going to ask for? Could you please point me in the right direction?? Many many thanks.
