  • Just got a notice of application out of the blue from ind ltd

    Postman just dropped a n55 through the door even though i had no correspondence from ind ltd

    now i have 8 days to pay or fill in a form or i can go to prison for 14 days even though i don't recognize this debt!

    there is nothing on the form to say i detest this debt just a question of what i earn and when will i pay

    HELP!!!

    N55 FORM??

    We are talking of an attachment of earnings application

    You must have a county court judgement against you, are you aware of such a judgement, and why was it not defended

      no not at all!!

      i moved house 14 months ago and my old address is 3 doors down that we sold last year, my previous correspondence with ind was at an address over 6 years ago

      i am on the registered for my council tax on my current address so i cant see any excuse for not finding me to give the appropriate paper work for a court date for a debt going to court

        They send it to last known address they don't check for a change of address have you checked to see if a CCJ is registered against you at ANY address?

          Hi Everyone, very much a newbie, looking for advice.
          I've been reading so much all evening on these forums, my eyes are literally rolling out of their sockets!
          I've found this thread to be the most applicable.

          I received a N55 too. I also had a notification of a CCJ (Northampton), but to be honest I was questioning it genuineness. The reasons being that I have had so much mail from Lowell Portfolio 1 Ltd
          demanding payment, that I just felt it was another scare tactic!. I'm at such a low state any way, that I thought Sod it! A CCJ it shall be then!

          The Notice of Application for Attachment of Earnings Order arrived, demanding payment within 8 days, return my earnings and employer details. My instinct was to do neither.

          I am not 100% sure what this debt is for. If I'm honest, I think it is from a Lloyds Bank overdraft that I got in trouble with about 13 years ago. Since then, (if it is that debt), I think we (my wife and I, as it was a joint account)
          were tracked down by Capquest some years later, and got into a routine of paying them a Tenner a month ( for a year or so, on and off) This stopped about 3 years ago, and I heard no more. In quick succession though, Lowell had found me at my now different address, and bombarded me with letters every other week. Some I returned as unsolicited mail, some I just binned.

          The Blue CCJ papers appeared, and I thought that would be the end of it. But now the N55 notice has appeared.

          My question is, whats the best thing to do from here?

          Should I contact the court and tell them that I do not recognise this debt with Lowell ( it wasn't with them, and is 13 years old)
          At the same time send a letter to Lowell (BW Legal) saying the same thing?

          Any advice would be welcomed

            Unfortunately I think you have missed the boat somewhat to defend this, you mention you received the blue court forms, presumably you then received the general form of judgment or order for a default judgment as you didn't respond? What did that order? Payment forthwith or by installment?
