    Hi there,
    Please I would again like some advise.

    My husband defaulted on his credit cards! 2007-8
    He agreed an amount £35 to Yorkshire £28.00 Mbna and £39.50 halifax
    YB sold the debt to marlin well said the account would Managed by them.
    & Same goes For Mbna and halifax

    I have a few issues queries if anybody would please advise us.

    1. Halifax credit card he got a Ccj in 2009

    They then sold to marlin who then sold or managed; by optima legal

    They have have been taking the agreed amount £40.00 for halifax DD

    On my husbands credit report my name appears as sharing the Ccj
    Which I think is unfair as he had it well before I met him.

    According to his credit file he has £650 outstanding
    As optima legal are now taking care if this
    my husband called the bank to ask about charges

    He went through each of the Standing orders DD

    One name to himself for £39.50 coming out since October 2008
    It turns out its halifax collections department?
    So we have been paying 2 Halifax payments received a CCJ we must Have overpaid
    Please anybody how do we handle this?
    optima legal are now reporting no payments for 6 months!

    It's no phone calls isn't it?
    Could I borrow a template or any advise

    MBNA Default 2009 Marlin have been taking care of this as far as I know

    The Credit file says payments then non payment
    Red marks for missed payments showing sporadic payments
    3 months missed then £120 paid is this to make our credit ratings worse.
    The debt hasn't gone
    down much at all but shows payments two years of payments at least
    for £40.00 a month Then gaps of non payment are they allowed to do this?
    It really confusing? I have a feeling they are trying to add even more monies on

    Marlin YB CD paying £70 A month showing sporadic payments too.
    I hope you can advise me on all issues .

    Okay lets have a look at Halifax first then

    After getting into financial difficulty he was paying £39.50 reduced payments on the debt directly with Halifax.
    Halifax sold the debt to Marlin, who got a CCJ in 2009 - payments agreed with court of £40 per month
    Following the CCJ the payments of £39.50 continued to Halifax AND £40.00 a month was also being paid to Marlin under the CCJ terms.

    So in essence £79.50 has been being paid to the Halifax debt each month?

      Hi there amethyst,
      Halifax got the CCJ in 2009 we didn't realize this until last week.
      When I think about it we have statements sent from halifax credit card
      With £39.50
      When husband was checking out all charges halifax sold the debt to marlin who sold the debt to optima legal who have now merged with marlin. But yes £79.50 has been taken also.
      We thought 3 payments going out for three accounts?

        So what's actually been going out of your account for THIS debt

        £40.00 going to OPTIMA
        £39.50 going to Halifax Collections

        ??

          Yes that's correct bearing in mind we got a Ccj in 2009 for non payment?

            Sorry for the Misunderstanding I now have the relevant info
            now update

            (MBNA £28 Per Month £28.00)
            Defaulted Early 2008
            After 3 Reduced payments of £28
            Balance approx (£2495.00) then Sold to MS Portfolio ltd a month later The account was being managed by
            Optima Legal (£40)
            Im assuming So Charges Could be added
            Including court costs.
            Balance October 2009
            £2900.95
            + court costs For Ccj legal fees £3331.37
            I'm fairly Certain we didn't receive any court papers
            We certainly didn't know about the charge on our house 2009
            + I'm sure (I would have been notified what with my interest in the house) as the Ccj is in my name too.
            (Not the credit card)
            We only found out sometime in 2014
            This must have been done on the sly because
            Every month we receive a threatening letter
            PI have all of them
            sometimes higher the balance is higher?
            if we don't pay they will apply for a Ccj or a charge
            on your property wages that's even when payment has been made or
            if we are lucky & managed to pass bank charges
            We would receive a nice letter a limited time offer
            To pay off the debt reducing the balance for cash payment


            I have CC statements from late Sept Oct Nov Dec 2008
            Jan 2009 payments were being met after
            WE RECEIVED £347 refund in refunded charges in 2010

            Yorkshire Bank CC Sold To Marlin Payments monthly payments creeping up from £20. 30. £40 £50 £60 £70
            Per Month now Weightmans 'Are Looking After the account

            (Halifax £39.50 Per Month Paid To Halifax)
