    Hi all,

    i was wondering, I received a ccj 5years (2009)ago while I was living over seas and wasn't aware that I had it, I sent led the account as soon as I found out about it in 2011, I was wondering is there any way I could speak this and have it removed from my credit file or do I need to wait until it drops off next year?

    The he reason I ask is that I have been working really hard to sort out my credit file ready to buy a house next year and this is the last thing holding me up, would this be at the discretion of the judge?

    i know it's a long shot any help would be appreciated

    If you received the CCJ 5 years ago it will come off of your credit file in the next year as they stay registered for 6 years,

      If you apply to have it set aside (at quite a hefty fee now), then you run the risk of having them bring the case back to court and having to wait another 6 years for it to fall off if they win. You also run a reasonable risk of not getting it set aside unless you can show how you never knew about it 5 years ago.

      I quite like a fight - however if I were you I'd keep quite for the next year. After the 6 years are up they have to go to court to get permission to try and get any money off you. And they will have to show/prove why they have not collected the money sooner. Unless they knew you were out of the country they will struggle to do this.

      On the other hand I suppose after 5 years of having the CCJ the chances of having the paperwork to have a hearing if you get it set aside is quite slim. But I wouldn't be betting on that if it was my financial history on the line for the next 6 years.

        Thanks for the advice so far the account is settled so no outstanding balance on it, would there be a way I could get it removed early if I was to admit fault and say I have learnt my lesson and would like the court to remove it so I can move on with my life or would they be strict on the 6 years? I know it's a random situation and request as I would be relying on the court showing mercy on more than anything

        what do we think to my chances?

          Zero - infact if any judge did that he would be acting unlawfully.

          Sorry to be the burden of bad news, but if you have paid it you just have to wait im afraid!

            Thanks that was the answer I was expecting, just thought they may be an outside chance, any way I could check the details of the claim and see if there is a way of appealing on grounds of lack of evidence?

              Not if you have paid it. I'm no lawyer but saying 5 years after a ccj that you have paid that you want to appeal is never going to work.

              there is an outside chance you could ask the original claimant but I'm not sure they could do anything, and I'm even less sure they would remove it if they could.

              I loce ice sticking it to the big guy and fighting for the little man (so much so that I've ruffled some feathers on here) but not even I can see that you have any realistic chance of getting that ccj off before your time is up.
