      Quick update

      Received a letter from CCBC Court saying they have received my defence and that they will now be sending it to the claimant. If no response in 28 days from the claimant the claim will be stayed

        Received this today and i am a bit perlexed

        I uploaded my defence on the 20/07/2014

        Received a letter from CCBC on the 22/07/2014 dated 21/07/2014 confirming they are going to send a copy of my defe
        nce to the claimant

        Received this letter of default sums for 22.00 dated 23/07/2014 received today 26/07/2014

        Anybody got any idea as to this charge of £22.00??

        All i can think of is the Directions/Allocation Questionnaire Fee.

        MCOL says different

        Allocation Questionnaire Fee (small claims, where claim exceeds £1,500, but under £5,000) (No fee if under £1,500)


        This claim is £1700.00 so far so confused as to what this £22.00 default sums as to litigation costs might be

          Another question?

          How can Litigation costs be added to a Consumer Credit Agreement???

          That is down to the judge to decide after litigation has started as to costs, Is it not??

          How can those costs be added to the Agreement. The agreement has been terminated once the N1 claim was issued

            The notice doesn't relate to any court or solicitors costs, it is a default charge, which must be allowable under the agreement. If you check through your agreement there should be a term in there about reasonable costs to recover debt, there should also be a term in there allowing these costs to be added after termination of the agreement. The amount certainly doesn't appear to relate to anything and those default fees shouldn't be being added by DLC - I'm not even sure where DLC have come into it.

                That is what i thought, They have not even stated what that £22.00 fee is chargeable against on the statement besides litigation costs.

                  The Claimant is Hillesden securities which i believe is a DLC group company (AS TO LETTER)

                  If the account has been assigned to Hillesden securities, how can DLC (Trading name) a seperate company issue notice of Default sums as they will not be the creditor

                  Getting my teeth into this now

                  DLC is a licensed trading style of Hillesden Securities Ltd a company registered in England and Wales (company number 1418063) authorised and regulated by the Financial Conduct Authority for accounts formed under the Consumer Credit Act 1974 (amended 2006).

                  Can i ask for an explanation as to the term "TRADING STYLE"

                  As Hillesden Securities is the Claimant, why is it being controlled by DLC as DLC is not the creditor the account has been assigned to (Hillesden Securities) a totally seperate legal entity

                  So on a N1 Claim Form can Hillesden Securities STATE that the account was assigned to them when it was infact ASSIGNED to DLC

                      On looking for info ref DLC and Hillesden I came across your thread on CAG (well if it isn't you its a very similar case ). You had a previous default charges notice from DLC too for £80.00? Pre litigation?

                      I am not sure on the differences between trading name and trading style and assignment to a parent company includes the trading styles of that company, I can only assume so but does seem misleading/confusing to be using DLC for these odd default charges which makes me think there must be some legal / regulatory need for them to come direct from named assignee. Not much help there sorry, more peeps will be about tmw xxx

                          Phoned MCOL, They have told me if i did not hear anything by today saturday, the claim will be stayed

                          Can anyone tell me exactly what that means please

                            Basically when you file your defence, the court will send a copy to the claimant. They have 28 days to respond saying whether they wish to proceed with the claim or not. If they don't respond, the claim is stayed. This means the case will not go any further until the claimant applies to the court to lift the stay.

                              Looks like it is Game on. I received the Directions Questionnaire from the court this morning. Seems Hillisden left it well late, only took 56 days.

                              I was under the impression the DQ was as to case management such as putting down what documents etc you will be requesting from the judge through court directions. All this N180 form was pushing the mediation process. I have no issue with that and all i can say to Hillisden is:

                              Bring it on, i am ready for you
