  • Nat west/arrow global/shoosmiths-CCJ claim form

    Hi


    Just wondering if anyone could help or point me in the right direction as I have received a claim from the courts saying claimant arrow global and payments for a debt with nat west to go to shoosmiths llp it was a debt from 2002/2003 I'm sure I've paid it but cannot be sure but I have had no contact with nat west since that time any ideas or suggestions as it's court on the 8th June

    it it also states that the account was assigned to the claimant on 15/12/2010

    If there's been no payments or written acknowledgment in the past 6 years, any debt would be statute barred and that's an absolute defence. In this case we're talking 11/12 years! :thumb:

    What do you mean by that? Have you got a court hearing on the 8th of June or is it your deadline to file a defence?

    When was this claim received and what's the date on the claim? Have you acknowledged service stating your intention to defend it in full? :confused2:

      it was received on Saturday I have today got back from a weekend break with the children the issue date was 21st of May and and it says you have 14 days and I also received a letter from shoosmiths saying that the request for a judgement will be made against you on the 8th of June my problem is how to fill the form out or do I just write statute barred

        You have 14 days to acknowledge service from the date on the claim, + 5 days allowed for service. Their calculations are based on the assumption that, if you don't acknowledge by the 8th, they can request default judgment. Once you acknowledge, you get a further 14 days to submit a defence. :clock:

        A statute barred defence would be as follows:
        The claimant’s claim was issued on the 21st of May 2014.

        The Claimant's defendant contends that the Claimant's claim so issued is a claim in contract and is statute barred pursuant to the provisions of Section 5 of the Limitation Act 1980. If, which is denied, the claimant contends that the Defendant is in breach of the alleged contract, in excess of 6 years have elapsed since the date on which any cause of action for breach accrued for the benefit of the Claimant.

        The Claimant's claim to be entitled to payment of £xxxx.xx or any other sum, or relief of any kind is denied.

            just wondering if someone could tell me how long it takes from when I submitted my defence to finding out what is happening as when I check online it just says defence received 29/052014 didn't know if there was a time limit for the claimant to respond

                Its usually 28 days for them to respond, then you will be sent the allocation/directions questionnaire if they do wish to proceed. If worried you could give the court a call and ask them the status of the claim.
                If the claimants don't respond then the claim may be stayed and they will need to apply to lift the stay.

                            Its going to come down to can they evidence that payment in August 2008.

                            Did you ask them for the CCA or CPR documents at all ?

                            If not I would send the CCA request now just by way of back up if its shown you did make the payment. http://www.legalbeagles.info/forums/...y-of-Agreement
