    They have 14 days to respond to the CCA request but you shouldn't chase this one.

      Please can someone help, am I to late to file my defence! :tinysmile_cry_t: I don't know why I forgot - work and life have taken over and I thought I had until June but I think I have made a massive error! Any help would be great.

        Okay don't panic - the deadline is 28 days PLUS FIVE FOR SERVICE - so your claim dated 1st May should be okay to 4th June so Monday should be fine.

          mmm okay, ring MKDP on Monday and ask them to email you their agreement to an extension to you filing your defence of a further 28 days, as you haven't had any information as requested from them and as such are not in a position to defend nor admit this claim.

          If they won't extend we'll have to file a defence stating the same.

                They havent replied to the CCA request or the CPR 31.14 OR the part 18 request have they ?

                You'll be fine, just need to decide whether to enter an application to force compliance with the CPR request or just go straight with a CCA defence.

                      Hello, please can someone point me in the direction of sample or template defence for credit card defence. I'm not being lazy, I have looked through quite a few threads but cant seem to find a common template. Thank you.

                        Quick update - called them and they agreed to an extension over the phone. I asked for it in an email and the replied that it would be sent today. I will however email them and also send a letter to the court. Is there any chance that it will be allocated to track anyway?

                        Side note to anyone that is interested. I gave them my email address and thought to myself what can they find out from it. I looked on Google and you can reverse lookup an email address for free! It is amazing how much info comes up! I would advise people in future to use a new email address purposely for the debt collectors!

                          That's good news! :clap2: When you get the email from them, forward it to the court saying both parties have agreed to an extension. :typing: Presumably they agreed to the full 28 days...

                          You mean any info that debt collectors wouldn't already have or that would be relevant to them?

                          That would depend on what email address you use, and the same can be said of using your email address to register on websites. These days you can easily create free email addresses on mail.com, mail2world.com, etc. in addition to the better known gmail, yahoo, hotmail, etc. The only problem is to keep track of and/or monitor all of them!

                            Thanks for your support FlamingParrot. I have chased them again this afternoon and they have no trace of my call this morning! Good job I now record all my calls! I have sent them an email with the calls attached! They confirm that they will email the ext for 28 days!

                            Really didn't know how a simple search shows your email address and all linked accounts such as Facebook and so on - FRIGHTENING!
