Re: MKDP County Court claim on Barclaycard

    Recon agreements don't have signatures.
    BUT MUST Have,

1, Your name and address as at the inception of the agreement.
    2. Creditors name and address as at inception.
3, All the T's & C's at inception and closure of the account.
    4. Any " material" amendments to the T's & C's made during the life of the agreement.
    5. Any other documents mentioned in the T's & C's.

A current statement (not historical) of the account.

Take your details off of them and post them up.

Also check the name and address on the recon was the same as it was upon opening the account. If notit's not an "honest and accurate" copy.

Re: MKDP County Court claim on Barclaycard

Hi on a quick scan of the documents I don't think there are two sets of T's & C's i.e. those at inception and those at closure.
NO name and address on some docs that a purporting to be theses T's & C's at closure if so I don't think there's enough pages.

I will check with agreements I have on file tomorrow.

Re: MKDP County Court claim on Barclaycard

Okay, the case will continue along 'normally' now they have complied with the order to supply documents.

So you will now need to file and serve your defence.

Did the order extending their time to 29th Dec give a new date for your defence?

Re: MKDP County Court claim on Barclaycard

Hi thanks . No there was no mention of any time period for me to submit defence . Just that MKDP was to submit the documents by the 29th or the claim would be struck out and to pay my costs . hence my assumption of 14 days

Re: MKDP County Court claim on Barclaycard

Yes I'd assume 14 days but would get it in asap.

So first step then is to list any issues with the documents and the dispute in the case overall, then you can work that into a defence.

You should also put in a Witness Statement with the defence stating the tardy time keeping of the claimants to date and all communications back and forth.
