        My partner has just rang the court.

        From what I can make out the proceedings are still ongoing as the person said that we should have sent a defence, and that if they wanted they could still obtain a judgment. She said there had been "no movement" on things.

        Would this mean we could apply to have it threw out as they did not respond in time? And if we did, could they not just start new proceedings now they have the relevant information to hand?

          It means you still have opportunity to put in a defence, or an admission and offer to pay, if you don't want to get a forthwith default judgment. You could shut it down completely by negotiating with the claimant so you don't have a CCJ against you but it sounds like they will want more money.

              Oh well, at least we tried.

              So we should now write to MC now proposing a payment plan in your opinion?

              Do you think it might be worth looking at bankruptcy as it will take us around 130 years or so to pay back based on our current financial situation. I don't think we could get a DRO as our combined debt is more than 15k, but I'm unsure if we could each obtain one seperately as our individual amounts are less than this?

                Hang fire a bit I'm getting a second opinion, but I'm not overly hopeful.

                What's your position, do you own your own home? is your credit file important ?

                Just to see whether to try negotiate with them direct or just to formally admit and offer installments through the court.

                Bankruptcy for £15k sounds excessive to me.

                  We have no assets of any kind. Our car is worth approximately £1000. Household goods amount to nothing, our tv's not even a flat screen

                  We have a credit card for £500 pounds which we clear monthly with my partners wages (which would be a loss as it comes in quite handy)

                  As for home owning, well I think we can mark that as distant.

                  We don't really have a lot to lose

                    Well, sounds like your situation is perfect as no, you have not a lot to lose, as you are on a low income the court would only order an affordable amount each month.

                    I've seen £20 a month on £10k debts if you wanted to push on, but then of course it is always there in the background. If you wanted to wipe the slate clean then you could look into a DRO - contact Stepchange or Citizens Advice for advice on this. The car might be an issue as it's worth over £300.
