  • N244 Files at Northampton CCBC-Help needed

    Hi All

    I got a Court claim from MKDP LLP and I made a CPR request and they said they need 8 weeks to see if they can full fill my request and they do not want to extend the period for my defense submission.So I decided with the information and advice I got from this Site,I followed the instructions and filed N244 for strike out. But after 16 days court write to me saying "The application to strike out the Claim must be heard on notice to the claimant.Transfer the action to the defendants home court". What i should do next? . Thank you so much in advance and a quick response is highly appreciated.

    Was the N244 for compliance with CPR 31.14 or strike out with draft directions? If so that's all good, it will be transferred to your local court so that you can attend the hearing and you should received notice of either a date, or the local court judge may make orders off his own back after reading your application.

    What kind of value is the claim and whats the debt ?

      Thank you so much for the reply Amethyst highly appreciated.Yes it was N244 for compliance with CPR 13.14 for information if not with in 14 days strike out.Value of claim is £10300 and it was a personal loan with HSBC.I write to HSBC for CCA but they replied saying that they could not find any information.

          Am i giving more time for MKDP to respond to my CPR request? Do i have to approach court to tell that it is already four weeks over and they did not comply with CPR request yet? Do i need to do any thing now? :help::help:
