I received a court order dated 10/03/2014. I sent back an acknowledgement of service and request for 14 more days. I have sent a CPR 31.14 to MKDP and had no reply in writing. I called MKDP and was told that they had received my request but it would take 8 weeks to sent me the required documents. My defence has to be sent by tomorrow. Should I complete the N244? Or send my defence back explaining that I have no documents so feel unable to defend my case? Many thanks for this site, its fantastic!

Re: Court order mkdp llp hsbc credit card
Sounds like you made a good start with this then got confuddled with them trying to stall you for 8 weeks for the documents. You should be okay to enter a defence explaining you think you had an hsbc card but unable to identify details as the claimants not given you any information and you've requested it under the CPR etc.
Otherwise you could call MKDP and ask them to agree an extension as they havent yet provided you with documents, get that agreement in writing under CPR 15/5 send it to the court.
If no documents arrive then you could submit an application for an order to force the claimants to comply with your CPR request.
I'm not sure how much the claim is for and whether you do recgnise it, how old it is etc, so hard to help specifically.#staysafestayhome
