    We need to check how much was the loan and how much the bank account, as they may try again for the bank account, unlikely but best to be aware.

                  I have also court claim from mkdp filled the defence now
                  Waiting for allocation questionare from judge
                  Original creditor barclaycard actual balance 11000k three year ago now 15000 plus court cost. Have been passed one debt agency to another one when requesting original copy of agreement but now mkdp sent me copy of agreement which is not eligible no terms,no credit limit is it true they have to provide
                  Original copy in the court signed by me not a photo copy to get ccj against me. Plz help

                    Hi, they can get away with a reconstruction of your agreement but I does need to be a true representation and must comply with the cca, ie contain the prescribed terms. I'll find your thread. Xx

                      Hi I have subbmitted my allocation questionaire due date 26th of August I submitted early to the court and sent copy to MKDP I have heard nothing since,what is likely to be the next step? I am sure the deadline applied to them also.

                        Ive won my case too!!! court advised by MKDP case settled ,judgement struck out happy days I am so gratefull to this forum and its contributors for all your help and assistance in this matter!!

                              Have received the court date now in one week time, mkdp sent me pre selected application which only got my name and address and the right hand side corner it's says credit agreement but it's dark and completely unreadable
                              Am I right assuming that
                              Credit card agreement must contain three prescribed terms
                              1 the amount of credit limit
                              2 the rate of interest
                              3 how the borrower is to repay the debt

                              Acknowledge Claim - within 14 days from Service

                              Defend Claim - within 28 days from Service (IF you acknowledged in time)

                              If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
