    Hi All,

    I have received the response attached from Restons some 7 months since I put in my defence . I am a bit surpised they have written to ask me to withdraw my defence by completing the N9A form.

    Any advice will be greatly appreciated.....

      Hiya, Nice of them to wait until just before Christmas isn't it. I don't think you have anything to worry about though. Else they'd have applied to court to lift the stay and continue the claim.

      So they still haven't provided you with a Credit Agreement ? Do the statements etc they have sent you clear up at all what the claim is for ? We know it's a loan at least.

        Hi Amethyst,

        Thanks for your reply. Yes nice Christmas present from them! I assume Restons trying to have the case struck out is not the same as having the stay lifted by the court?

        I have not received any Credit Agreement. The statement they sent show some dates and amounts paid printed on plain paper. They have also enclosed the N9A form.

        Should I just ignore their letter? How do I check if the stay has been lifted and how much more time do Restons have to try and get the stay lifted?

          I think we should reply to their letter, saying you won't be withdrawing your defence as they still haven;t supplied the CCA or any other documents and the debt is unenforceable, and has been stayed in court for 7 months, and you'll consider writing to ask the court to consider striking out the claim unless they withdraw it.
