  • CCJ Offer of Settlement URGENT

    Hi,

Need help really urgent. I have a CCJ with a Payday loan company. The original loan was for £200 repayment was £250 in 2011. They got a defaulted judgement in May 2012 for £1494. Now as I am on ESA Support group Benefit and I have no assets (I live at home with my parents) I also am not earning and wont be for the foreseeable future. The amount is now from what the company say is £1560 which is post judgement interest. I want to make a settlement offer to them what do you think is reasonable. I'm thinking £800? I need to reply as they have asked me to make an offer.

Thanks for any help in advance! xx

Blinking heck loulou - wait till you get your cheque first but yes a 50% offer is reasonable and more likely to be accepted than starting at 35% or something, though if £800 is as high as you want to go you might be best off offering 35% now and increasing to 50% later.

    What's their letter say?

That's awful how much it grew to the default judgment (but you know that already) so this is just a good opportunity to get it out of your hair for good.

If they accept the offer will the CCJ still stay on record till the 6 years are up?

A CCJ is 'satisfied' once you have paid the full amount you owe and the claimants should tell the court that so it is marked as such on your credit file and the CCJ register.

Can they be trusted lol. Ill make sure I have a signed letter from them that x amount is what they have accepted and when I pay I will also have proof from a bank statement if they don't and seek further payment. They still haven't got back to me? Took 3 mins when I asked if they would agree to a settlement. xx

To get the CCJ marked as Satisfied you have to provide proof to the Court and pay for a Cerificate of Satisfaction - about £15 I think. The Court will then notify Registry Trust who will in turn notify the CRA's.
